The following is the judgment delivered by THE COURT (Orally) [ 1 ] After considering the record and hearing counsel for the appellant, we conclude the standard of review articulated in The Beaverbrook Canadian Foundation v.
The Beaverbrook Art Gallery , 2006 NBCA 75 , 302 N.B.R. (2d) 161, at para. 4 , forecloses interference with the motion judge's discretionary order requiring the appellant “re-attend for a discovery and [...] answer any question arising out of, and confined to, the undertakings and documents produced since the examination for discovery of 8 June 2007”. Accordingly, the appeal is dismissed, with costs of $2,500 payable to the respondent. __________________________________________ J.
