Article 95 L.P.J. ______________________________________________________________________ MISE EN GARDE : La
Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d'identifier un enfant ou ses parents.
Quiconque contrevient à cette disposition est passible d'une amende. [articles 11.2.1 et 135 L.P.J .] [ 1 ] Le présent jugement constitue la version écrite et motivée confirmant le jugement rendu oralement lors de l'audience tenue le 16 février 2016. [ 2 ] Le Tribunal est saisi d’une requête en prolongation de l'ordonnance rendue le 2 mars 2015, dans laquelle il déclarait que la sécurité et le développement de l'adolescent étaient compromis et, en conséquence, ordonnait son hébergement en centre de réadaptation pour une période de six (6) mois. [ 3 ] Le Tribunal ordonnait certaines autres mesures visant à corriger la situation. [ 4 ] La requérante, la Directrice de la protection de la jeunesse («DPJ»), allègue que la situation de l'adolescent exige une prolongation d'ordonnance pour certains motifs liés à son évolution personnelle, à ses besoins et à la capacité du milieu à y répondre. [ 5 ] La mère admet tous les faits allégués dans la requête et son procureur exprime qu'elle est en accord avec le contenu du rapport et les recommandations. [ 6 ] L'adolescent, par le biais de son procureur, fait également une admission générale des faits allégués dans la requête et exprime son accord avec les recommandations. [ 7 ] Situation de l'adolescent [ 8 ] Tenant compte des admissions formulées par la mère et l'adolescent, de même que la preuve documentaire, le Tribunal conclut que la requête est bien fondée en faits et en droit et, en conséquence, déclare que la situation de l'adolescent exige une prolongation d'ordonnance pour les motifs allégués. [ 9 ] Le Tribunal retient les éléments suivants : [ 10 ] The adolescent resided at A Group Home during his placement; [ 11 ] The adolescent was fully integrated home on August 17, 2015; [ 12 ] The family was assessed for the Transition-Diversion Program and an educator was assigned to them;
[ 13 ] In addition, the mother participated in a Transition-Diversion parent group; [ 14 ] During the summer of 2015, the adolescent did volunteer work with pre-adolescent at the YMCA A and it was reported he did well and was appreciated; [ 15 ] In October 2015, respite was necessary for two (2) overnights at the group home, because of the adolescent's attitude at home and unaccountability; since then, it is reported that the communication between the adolescent and the mother is better; [ 16 ] The adolescent began seeing a therapist at the Douglas Hospital in November 2015; [ 17 ] During the present school year, the adolescent experienced some academic difficulties in school, but was able to catch up; the adolescent participated in tutorial classes; [ 18 ] Even if the mother has improves her capacity to maintain a routine and supervise the adolescent at home and in the community, she can be inconsistent at times due to her fragile health and difficulty to manage her stress; [ 19 ] The adolescent has initiated contact with the father but stated that he wants to go slowly; [ 20 ] The family needs to maintain the gains. [ 21 ] Mesures [ 22 ] [Intervenant 1], personne autorisée par le DYP, dans son rapport [1] daté du 24 décembre 2015, analyse ainsi la situation : « The family has collaborated with the TD program over the course of follow up, including the use of respite.
They have been able to establish better communication, interaction and an agreeable structure that both meet their needs and has shown some improvement in their overall capacity to function. Although there are noted gains, the family has continued to need regular educator/TD follow up with regard to how X manages his community time, his continued but better managed sexually provocative internet activity on Facebook.
Additionally, although mother has improved her ability to oversee, supervise and maintain the home and community structure, and follow up school related issues/concerns, her sometimes waning capacity to find the energy to address these with X sometimes falls short due to her fragile health and ability to manage her stress.
TD recommends that it would be prudent to support the family's with for another period of follow up in order to solidify their gains. » [ 23 ] L'intervenant social identifie le but et les objectifs visés par l'intervention [2] dans les termes suivants : • « That X succeed at school; • That mother and X continue to improve their communication and interaction; • That mother maintains consistent structure and expectations of X, including consequences when necessary; • That X respects and follow his curfew/being accountable, and his mother's final authority. » [ 24 ] Tenant compte des besoins de l'adolescent, de sa collaboration et de celle de la mère avec les intervenants, tenant compte de leur adhésion au plan recommandé par la requérante, le Tribunal conclut que les recommandations sont dans l'intérêt de l'adolescent. [ 25 ] CONSEQUENTLY, THE COURT : [ 26 ] GRANTS the motion; [ 27 ] DECLARES that the security and development of the adolescent X continue to be endangered for the reasons alleged in this present motion. [ 28 ] THEREFORE, ORDERS THE FOLLOWING MEADURES : [ 29 ] ENTRUSTS the adolescent X to the care of his mother; [ 30 ] ORDERS that the adolescent and his mother continue to collaborate with the Transition-Diversion Program , including the use of respite when needed; [ 31 ] ORDERS that the adolescent and his mother, together or individually, participate in therapeutic services to promote their relationship and to address their personal challenges; [ 32 ] ORDERS that aid, counsel and assistance be provided to the adolescent X and his family; [ 33 ] THE WHOLE until June 23 rd , 2017. [ 34 ] ENTRUSTS the situation of the adolescent X to the Director of Youth Protection of the CIUSSS a.
