Lahey The following is the judgment delivered by THE COURT (Orally) [1] R & D Rademaker Enterprises Inc. filed a “Notice of Appeal Alternatively, Notice of Leave to Appeal” against an interlocutory decision a judge of the Court of Queen’s Bench rendered on June 14, 2010. [2] Since the decision under appeal was interlocutory in nature, leave to appeal is required: Rule 62.03(1)(
a) of the Rules of Court . To the extent that the “Notice of Appeal Alternatively, Notice of Leave to Appeal” purports to be a Notice of Appeal, it is quashed as there is no right to appeal the decision in question.
