PARTIE INTIMÉE - Intimée Et PROCUREUR GÉNÉRAL DU CANADA SERVICE CORRECTIONNEL DU CANADA COMMISION DES LIBÉRATIONS CONDITIONNELLES MIS EN CAUSE – Mis en cause [ 1 ] L’appelant-requérant demande que son appel soit entendu par une formation composée de cinq juges. Il entend notamment soutenir au fond que l’arrêt rendu par cette Cour dans Perron c.
Tremblay , 2017 QCCA 1407 [1] doit être réexaminé puisqu’il a été rendu per incuriam et en raison des prétentions d’inconstitutionnalité et des nouvelles questions de droit que l’appelant entend soulever. [ 2 ] La jurisprudence reconnaît qu’il existe en common law un principe voulant qu’une cour d’appel qui souhaite revoir l’un de ses précédents le fera avec une formation composée d’au moins cinq juges [2] . [ 3 ] En première instance, la juge a décliné juridiction sur la requête en habeas corpus et certiorari ancillaire ainsi que sur les questions d’inconstitutionnalité de certaines dispositions du Règlement sur le système correctionnel et la mise en liberté sous condition [3] et de la
Loi sur le système correctionnel et la mise en liberté sous condition [4] au motif que « le requérant n’a fait valoir aucun argument permettant au Tribunal de renverser la position de la Cour d’appel du Québec maintenue depuis des années. » [5] [ 4 ] Devant moi, l’appelant requérant a plutôt soutenu que son appel échappe aux précédents de la Cour. En d’autres termes, la jurisprudence concernée serait inapplicable à son cas. [ 5 ] Rien n’empêche l’appelant de faire valoir cette position devant une formation de trois juges, qui pourrait l’accepter sans écarter pour autant cette jurisprudence établie.
Rien ne l’empêche non plus de faire valoir ses moyens d’inconstitutionnalité devant une telle formation. [ 6 ] Je crois opportun de citer ici un extrait de la décision de la Cour d’appel de l’Ontario dans Ontario (Attorney General) v.
Collins , 2012 ONCA 76 : [7] In our view, the motion must be dismissed on the ground that there is no authority to review or appeal a decision of the Chief Justice of Ontario or the Associate Chief Justice of Ontario to assign, or to refuse to assign, five judges to hear an appeal. [8] The Chief Justice of Ontario and, in his or her absence, the Associate Chief Justice of Ontario, has, by virtue of the Courts of Justice Act, s. 5(1) and (2) "general supervision and direction over the sittings of the Court of Appeal and the assignment of judicial duties of the court." It is pursuant to that authority, and to the court's practice, that those judicial officers determine when it is appropriate to assign five judges to hear a case.
Neither the Courts of Justice Act nor the Rules of Civil Procedure provide for any appeal or review from decisions of the Chief Justice or Associate Chief Justice with respect to the assignment of judicial duties. [9] We would add, however, that it is still open to a panel of three judges assigned to hear a particular case, to ask the Chief Justice to consider assigning the case to a panel of five judges if that panel of three is persuaded that an arguable case can be made for reviewing or
overruling one of this court's past decisions. [ 7 ] Les membres de la formation qui doit entendre cet appel le 2 octobre 2018 ne m’ont adressé aucune demande au sens du paragraphe 9 précité de l’affaire Collins .
