HEARING The Appellant/Respondent having consented to the application being granted, the parties were excused from appearing in Court. BY THE DEPUTY CLERK: Judgment – See page 3. Melanie Camiré , Clerk at the hearing JUDGMENT [ 1 ] The appellant was charged in two separate files in first instance. On February 3, 2022, the Honourable Geneviève Graton, J.C.Q. dismissed the appellant’s applications to stay the proceedings, and did so in one and the same judgment for both files.

The appellant appealed against that judgment and opened two separate files at the Court of Appeal. [ 2 ] I am now seized of an application by the respondent seeking the authorization to file a single brief for both appeal files, an application the appellant does not contest. [ 3 ] In my opinion, this application is unnecessary in the present circumstances. In fact, a single appeal file could have been opened, because the appeal involves only one judgment.

Thus, the respondent does not need the Court’s authorization in order to file a single brief not exceeding 30 pages for both files. [ 4 ] In light of the foregoing, it appears appropriate that a joint hearing be held for both files. Consequently, the Court office will link the files in the plumitif. FOR THESE REASONS, the undersigned : [ 5 ] NOTES that the present application is moot; [ 6 ] TAKES NOTICE of the respondent’s intention to file a joint brief not exceeding 30 pages in files 500-10-007767-229 and 500- 10-007768-227; [ 7 ] THE WHOLE , without legal costs.
