LOI SUR LA PROTECTION DE LA JEUNESSE ______________________________________________________________________ MISE EN GARDE : La
Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d’identifier un enfant ou ses parents.
Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.). ______________________________________________________________________ [ 1 ] La Directrice de la protection de la jeunesse (la Directrice) demande au Tribunal de déclarer compromis la sécurité et le développement des enfants en raison de la violence familiale dont ils ont été témoins, de même que des risques de négligence dus aux problèmes de la mère. [ 2 ] Les enfants ont fait l’objet de trois ordonnances provisoires, dont la première le 18 août 2016 confiant les deux enfants à leur mère.
Or, la mère n’a pas respecté l’interdiction de contact avec son ancien conjoint, monsieur A. Dans les circonstances, le Tribunal confiait les deux enfants au père de Y, soit monsieur B. Le 13 septembre 2016, monsieur B se dit incapable de s’occuper des enfants plus longuement et le Tribunal confie Y en centre de réadaptation et X en famille d’accueil. [ 3 ] Le Tribunal déclare compromis la sécurité et le développement des enfants le 5 octobre 2016 en raison de la violence familiale dont ils ont été témoins.
Le Tribunal réserve aussi son droit d’ajouter d’autres motifs de compromission et motive sa décision de rendre des mesures intérimaires de la façon suivante : CONSIDERING that conjugal violence between mother and Mr. A is an issue in conformity with
section 38c) of the Youth Protection Act; CONSIDERING that Y’s father was aware of the conjugal violence incident within the mother’s family; CONSIDERING the undertaking signed by Mr.
A dated August 24, 2016 which forbids him to have any contact with the mother and the children; CONSIDERING that Y’s father recognized consuming marijuana on a daily basis; CONSIDERING that the Director of Youth Protection is searching for a foster family capable to take care of the two children; CONSIDERING that the children long term placement is still highly contested by the mother; CONSIDERING that the father’s position to have the children back at their mother’s house; CONSIDERING that the Director of Youth Protection, with the resources department, is looking for a suitable foster home for both children and hoping to find one within the next month; CONSIDERING that the mother contests the content of the police reports filed under D-3; CONSIDERING that the parents want regular contacts with their children; CONSIDERING that the Director of Youth Protection wishes to increase the duration of the visits if the situation of the mother continues to go well;
CONSIDERING the request for interim measures for the next three months. [ 4 ] Le 16 janvier 2017, le Tribunal retient comme nouveau motif le risque sérieux de négligence pour les enfants en raison des difficultés de la mère. De plus, les difficultés d’apprentissage scolaires de l’enfant doivent être examinées et les parents s’y opposent.
Tout en permettant à la Directrice de faire évaluer Y en retirant l’exercice de cet attribut aux parents, le Tribunal motive sa décision sur les mesures finales le 19 janvier dernier de la manière suivante: CONSIDERING that the Director of Youth Protection requests for interim measures for a period of three months; CONSIDERING that the mother wants the children back to her care immediately; CONSIDERING that Y’ father supports the mother’s request; CONSIDERING the police officer’s testimony confirms that the mother was under the influence of alcohol when her partner was physically violent towards her; CONSIDERING that the mother has completed since the last hearing, three drug tests but one was positive with cocaine, which result that the mother adamantly denies; CONSIDERING that Mr.
A was brought to prison for breaching his undertaking condition restraining him to be in contact with mother and her children; CONSIDERING that X is doing well in foster family and he is scheduled to see an eye doctor on next January 24, 2017; CONSIDERING that Y has been exposed to many conflicts in the past and is more aware of his parents’ issues; CONSIDERING that Y struggles in school and the Director of Youth Protection recommends that the child undergoes a psychoeducational assessment to identify the services required to support him; CONSIDERING that the parents, particularly the mother, are reluctant to authorize their son to participate with this assessment; CONSIDERING that the children have extended visits with their mother, including overnights since December 24, 2016; CONSIDERING that Y has regular visits with his father; CONSIDERING that the mother is seven months pregnant of Mr A child and should deliver the baby on April 5, 2017; CONSIDERING that the mother will not resume her relationship with Mr A; CONSIDERING that the goal of the Director of Youth Protection is to reintegrate both children with their mother within the next three months; CONSIDERING that Y is pleased in group home but wants to go back home; CONSIDERING that the Director of Youth Protection, if the Court grants the parents’ demand, propose instead final measures. [ 5 ] THEREFORE, THE TRIBUNAL: [ 6 ] GRANTS the motions; [ 7 ] DECLARES that the security and development of the children are endangered under sections 38c) and 38 b)2 of the Youth Protection Act ; [ 8 ] AS FAR AS THE MEASURES ARE CONCERNED: [ 9 ] MAINTAINS Y in rehabilitation center and X in foster family until January 27, 2017 and then, ENTRUSTS both children to the care of their mother at the exclusion of Mr.
A; [ 10 ] ORDERS the mother to ensure that the children have no contact with Mr. A; [ 11 ] ORDERS that the parents ensure that the children are not exposed to any forms of violence; [ 12 ] ORDERS that the parents refrain from denigrating one another and from sharing inappropriate adult subjects in the presence of the children and TAKES JUDICIAL NOTICE of their agreement to do so; [ 13 ] RECOMMENDS that the mother involves in therapeutic services provided by IVAC and TAKES JUDICIAL NOTICE of her consent to do so; [ 14 ] RECOMMENDS strongly that the mother and Mr.
B participate in random drug testing when requested by the Director of Youth Protection and TAKES JUDICIAL NOTICE of their agreement; [ 15 ] ORDERS that the frequency and modality of contacts between Mr. B and his son Y and X be determined by DYP after agreement between the parties; [ 16 ] WITHDRAWS from the parents the parental authority for Y in regards to psychoeducational assessment and ORDERS that Y undergo a psychoeducational assessment and follow through with the recommendations of the professionals;
[ 17 ] ORDERS that Y undergo a psychoeducational assessment and follow through with the recommendations made by professionals; [ 18 ] ORDERS that Y receive therapeutic services for the trauma he experienced and TAKES JUDICIAL NOTICE of the mother’s consent to continue the process with IVAC; [ 19 ] ORDERS the mother to ensure that X’s medical and educational needs are met; [ 20 ] ORDERS that aid, counsel and assistance be provided to the children and their family and TAKES JUDICIAL NOTICE that an educator from the Coltron group home will support the family; [ 21 ] THE WHOLE for nine months; [ 22 ] ENTRUSTS the situation of the children to the Director of Youth Protection of A Youth and Family Centres , who shall then see that the measures are carried out.
