CAUTION: The Youth Criminal Justice Act prohibits the publication of the name of a child or young person, or any other information that could identify him or her as a young person dealt with under this Act, or as having been a victim of, or as having appeared as a witness in connection with, an offence committed or alleged to have been committed by a young person, except by court order..
Anyone who contravenes these provisions is liable to criminal prosecution. ( Sections 110(1) , 111(1) and 138 Y.C.J.A. ) [ 1 ] On June 19, 2019, the Appellant was found guilty of uttering threats, handling a firearm in a careless manner, causing bodily harm to A and to B and confining A and B. This case is subject to the Youth Criminal Justice Act . [1] [ 2 ] On May 10, 2021, he was sentenced to eight months of detention, two thirds of the sentence to be served in prison and one third under supervision in his community. [ 3 ] The Appellant now seeks leave to appeal the sentencing judgment.
He alleges that the trial judge failed to properly consider the time spent in an adult detention centre between April 19 and May 20, 2021. He also failed to consider the sentencing principles set forth in the Youth Criminal Justice Act , as he did not analyze the possibility of imposing a sentence other than detention. [ 4 ] The Appellant also seeks his release pending the determination of his appeal of the verdict. [ 5 ] The Respondent does not oppose either application. [ 6 ] I am convinced that the grounds of appeal warrant examination by the Court and that leave to appeal should be granted.
I also consider that the Appellant has demonstrated that he satisfies the conditions set out in section 679 (3) Cr.C . and I further find that his application for interim release should be granted. [ 7 ] The fact that leave to appeal is being granted implies that I do not consider the grounds of appeal to be trivial. I have no reason to believe that the Appellant will not surrender himself into custody if ordered to do so.
As for the necessity of the Appellant’s continued detention in the public interest, I must take into account the fact that he was not in detention pending his trial or his sentencing and that the Direction de la protection de la jeunesse is involved in the case of B and will take all necessary measures to ensure the security of the child. Moreover, even if the appeal is heard promptly, the Appellant will most likely have served his sentence. This means that, if his appeal is allowed, he will have been punished unnecessarily.
I think that the conditions set out below, which are quite similar to those recommended in the Gladue report and in the pre-sentencing report, should be sufficient to ensure the security of the complainant and of the public. FOR THESE REASONS , THE UNDERSIGNED: [ 8 ] GRANTS the application for leave to appeal; [ 9 ] GRANTS leave to appeal the sentencing judgment rendered by Justice Marc E.
Grimard, J.C.Q. on May 10 th , 2021; [ 10 ] ORDERS that the Appellant, after notifying the respondent, file with the Office of the Court, no later than 30 days after the notice that the record on appeal is complete (art. 30 Rules of the Court of Appeal in Criminal Matters ( R.C.a.Q.c.m . )) , fives copies of the documents mentioned at
article 60 R.C.a.Q.c.m . and, if applicable, an argument of no more than 10 pages ; [ 11 ] ORDERS that the respondent, after notifying the Appellant, file with the Office of the Court, no later than 30 days after the file of the documents mentioned at
article 60 R.C.a.Q.c.m . and the argument of the Appellant , fives copies of the documents mentioned at
article 60 R.C.a.Q.c.m . and, if applicable, an argument of no more than 10 pages ; [ 12 ] ORDERS that the parties, as provided by
article 60 R.C.a.Q.c.m., file their argument drafted on good qualify white letter paper (21.5 cm by 28 cm) with at least one and one-half spaces between the lines (except for quotations, which shall be single-spaced and indented). The typeface shall be 12-point Arial font for the entire text. Exceptionally, 11-point Arial font may be used for quotations and 10-point Arial font may be used for footnotes. The margins shall be no less than 2.5 cm.
The text shall be reproduced on one side only of each sheet (art. 18 par. 2 R.C.a.Q.c.m . ); [ 13 ] ORDERS that the documents filed include a cover page and a table of contents with pages numbered consecutively; [ 14 ] ALLOWS the respondent, as provided by the second paragraph of
article 60 R.C.a.Q.c.m . , to notify the duly completed questionnaire to the Appellant and file fives copies of the questionnaire with the Office of the Court, no later than 21 days before the date of the hearing of the motion for leave or the appeal; [ 15 ] ORDERS the parties to attach a technological version as a USB key to each copy of their documents filed in lieu of the brief. This version must permit keyword searches and include hyperlinks from the table of contents to the brief and from the argument to the schedules.
The USB key shall be identified in the same matter as a pleading (art. 12 R.C.a.Q.c.m . ) ; [ 16 ] REMINDS the parties that they may file a book of authorities with the Office of the Court, after notifying the other party. It shall be prepared in accordance with
article 44 R.C.a.Q.c.m . and be filed 30 days before the hearing of the appeal (art. 46 R.C.a.Q.c.m . ); [ 17 ] DEFERS the file to the docked master in order to declare the file ready for hearing and set a trial date; [ 18 ] GRANTS the application for interim release; [ 19 ] ORDERS the Appellant’s release, under the following conditions:
1- The Appellant shall keep the peace, be of good behaviour and attend court whenever required; 2- The Appellant shall reside with his grandmother, C, at […], Town A, […]; 3- The Appellant shall notify the Court in advance of any change of name, address or occupation; 4- The Appellant shall not apply for a passport; 5- The Appellant shall make reasonable efforts to obtain and maintain employment or to pursue his education; 6- The Appellant shall abstain from threatening, harassing or molesting A; 7- The Appellant shall not be in the physical presence of A and shall immediately leave any public premises where she is present; 8- Within 72 hours of his release, the Appellant shall register with the [Center A] in order to continue working on his issues, including alcohol abuse, and on healing and anger management. 9- Within 72 hours of his release, the Appellant shall register with the Justice Committee of Town B; 10- The Appellant shall not possess or carry, in any capacity whatsoever, offensive or restricted weapons, or imitations of weapons, including starting pistols and pellet guns, firearms, crossbows, prohibited weapons, restricted weapons, prohibited devices, ammunition, prohibited ammunition, explosive substances, knives (except in restaurants and for a legitimate purpose) or bladed weapons; 11- The Appellant shall not consume any alcohol, narcotics, drugs or other intoxicating substances, except in accordance with a medical prescription, outside of his residence; 12- The Appellant shall surrender himself into the custody of the prison authorities within any time limit fixed by the Court if his appeal is dismissed, or immediately if this appeal is discontinued. [ 20 ] ORDERS that an undertaking of these conditions be given before a justice of the peace assigned to such matters prior to the Appellant being released from custody.
