The proposed evidence relates to whether the Financial and Consumer Services Tribunal erred in rendering a decision without the Board of Trustees having been a party to the proceedings despite being directly affected by it.
No one opposes the Board’s application to adduce evidence. However, the Fredericton Police Association, Local 911, United Brotherhood of Carpenters and Joiners of America, and the Fredericton Fire Fighters Association, International Association of Fire Fighters, Local 1053, wish to adduce reply evidence and seek direction under Rule 62.21(3) of the Rules of Court . [ 2 ] We are of the view that this is an appropriate case to allow new evidence solely on the question of the notice or lack of notice, actual or formal, the Board of Trustees had of the proceedings before the Tribunal.
Pursuant to Rule 62.21(3), we direct the evidence be adduced in the form of the affidavits of Wade Kierstead and Shane Duffy, which the parties have filed in support of their respective positions, as well as an examination of one representative of the Board of Trustees, and one representative of each of the Fredericton Police Association and the Fredericton Fire Fighters Association, before an examiner under Rule 33. [ 3 ] There is no order of costs. ____________________________ M.E.L. LARLEE, J.A.
_____________________________ J.C. MARC RICHARD , J.A . _____________________________ RAYMOND T. FRENCH, J.A .
