COURT OF APPEAL OF NEW BRUNSWICK 43-11-CA CARMEN DRAKE AUGUSTINE APPELLANT CARMEN DRAKE AUGUSTINE APPELANT - and - - et - HER MAJESTY THE QUEEN RESPONDENT SA MAJESTÉ LA REINE INTIMÉE Augustine v. R., 2012 NBCA 7 Augustine c.
R., 2012 NBCA 7 CORAM: The Honourable Justice Deschênes The Honourable Justice Robertson The Honourable Justice Bell CORAM : L’honorable juge Deschênes L’honorable juge Robertson L’honorable juge Bell Appeal from a decision of the Provincial Court: February 22, 2011 Appel d’une décision de la Cour provinciale : Le 22 février 2011 History of Case: Historique de la cause : Decision under appeal: Unreported Décision frappée d’appel : Inédite Preliminary or incidental proceedings: N/A Procédures préliminaires ou accessoires : s.o.
Appeal heard: January 17, 2012 Appel entendu : Le 17 janvier 2012 Judgment rendered: February 2, 2012 Jugement rendu : Le 2 février 2012
Counsel at hearing: For the appellant: Richard L. Cove For the respondent: Cameron H. Gunn Avocats à l’audience : Pour l’appelant : Richard L. Cove Pour l’intimée : Cameron H. Gunn THE COURT The appeal and applications for leave to appeal are dismissed. LA COUR L’appel et les demandes d’autorisation d’interjeter appel sont rejetés. The following is the judgment delivered by THE COURT [ 1 ] The appellant was convicted of four counts of intentionally causing damage by fire to a dwelling house ( s. 433 (
a) of the Criminal Code ) and one count of attempting the same offence. The trial judge imposed a total sentence of imprisonment for five years. Of the 13 grounds of appeal raised in the Notice of Appeal, the appellant pursued 9 before the Court. Two of the grounds relate to the sentence.
The remaining grounds pertain to the conviction and raise either questions of law alone, questions of fact or questions of mixed law and fact. [ 2 ] A person who is convicted of an indictable offence may appeal against conviction on any ground that raises a question of law alone, and otherwise only with leave of the court or a judge thereof (see s. 675(1)(a)). Leave to appeal is required to appeal the sentence (see s. 675(1)(b)). [ 3 ] In our view, there is simply no merit to any of the grounds of appeal.
As a result, the appeal with respect to questions of law is dismissed, as is the application for leave to appeal on grounds that raise questions of fact or of mixed law and fact. Similarly, we dismiss the application for leave to appeal against the sentence. ______________________________________ ALEXANDRE DESCHÊNES, J.A. _______________________________________ J.T.
