English version of the decision delivered by THE COURT [1] This appeal came for hearing on January 17, 2013. It is an appeal against a decision a judge of the Court of Queen’s Bench rendered on July 27, 2012, granting the respondent
summary judgment on the liability aspect of a contract claim and directing a trial on the issue of the amount owed. The trial to determine the amount is scheduled for February 2013. [2] At the hearing, we inquired of the parties whether it might not be best to adjourn the hearing of this appeal pending the determination of the amount of the judgment so that, in the event that aspect of the matter is also appealed, all questions could be submitted to this Court at the same time. All agreed. [3] As a result, we directed that the hearing of
this appeal be adjourned to a date to be fixed by the Chief Justice once the parties have either advised the Registrar that no appeal will be taken from the outcome of the upcoming trial, or perfected any resulting appeal, as the case may be. If any appeal on the question of the amount of the judgment is perfected, it shall be heard at the same time as this appeal. ________________________________ Alexandre Deschênes, j.c.a. ________________________________ J.C.
