[ 1 ] JH5272 Le Tribunal est saisi d'une requête en révision d'une ordonnance rendue par le soussigné le 1 er mai 2015. [ 2 ] Le Directeur recommande le placement de l'enfant dans sa ressource actuelle jusqu'à sa majorité.
Les parties consentent. [ 3 ] X vit chez madame C depuis le 13 juin 2014, sans interruption. La situation n'a à peu près pas évoluée. [ 4 ] La mère refuse des services du centre de réadaptation de l'Ouest de Montréal (CROM). Elle n'a toujours pas complété de traitement auprès du Foster Pavillon. [ 5 ] Quant au père, il entre et sort de prison régulièrement.
À l'heure actuelle, il vient d'être libéré et fait l'objet d'une probation de 2 ans à la suite d'un incident de violence envers la mère. [ 6 ] Les deux parents admettent qu'ils ne sont pas en mesure d'assumer la responsabilité de leur fille et confirment que madame C s'acquitte très bien de la tâche.
FOR ALL THESE REASONS, THE COURT: [ 7 ] GRANT the motion; [ 8 ] DECLARES that security and development of the child are still compromised; [ 9 ] ENTRUSTS the situation of the child to the Director of Youth Protection A, who shall then see that the measures are carried out: [ 10 ] RENDERS an order aimed at ensuring continuity of care and stable living conditions; [ 11 ] ENTRUSTS the child to a foster family; [ 12 ] TAKES JUDICIAL NOTICE that the Director has chosen the family of C and ORDERS that the child remains in this family; [ 13 ] ORDERS that contacts between the parents and the child take place following modalities to be established by the Director at a frequency to be agreed upon between the parties, failing an agreement, they will take place once every second month; [ 14 ] THE SAID CONTACTS will be conditional to the parents' sobriety at the time of the contacts, and to their peaceful collaboration with the Director's follow-up;
[ 15 ] TAKES ACT of the parents' commitment to participate in a drug rehabilitation program; [ 16 ] WITHDRAWS certain attributes of parental authority from the parents and ENTRUSTS these attributes to C who will take decisions regarding health care, school registration, activities, travel authorizations including requesting a passport, if necessary; [ 17 ] ORDERS that aid, counsel and assistance be provided to the child and the parents; [ 18 ] ORDERS the execution of the judgment by any peace officer, if needed; [ 19 ] THE WHOLE until majority .
