Alya Elisio Greffière d'audience PAR LE JUGE JUDGMENT [ 1 ] The Petitioners seek leave to appeal from the judgment of the Superior Court, District of Montreal (the Honourable David R. Collier) dated January 9, 2019, [1] which dismissed their applications for judicial review of the decision of the Financial Markets Administrative Tribunal (Mtre Jean-Pierre Cristel) dated November 22, 2017.
The Tribunal had dismissed the declinatory exceptions made by the Petitioners in which they challenged the jurisdiction of the Tribunal to hear an action brought by the Autorité des marchés financiers (AMF) against the Petitioners for alleged infractions under the Québec Securities Act . [2] [ 2 ] The motions for leave to appeal are brought under
Article 30 C.C.P. The questions raised in the proposed appeal, principally the extraterritorial jurisdiction of the Tribunal and the standard of review when the decision of the Tribunal on its jurisdiction is taken on judicial review to the Superior Court, are questions of importance on which the Court has not yet expressed itself. In the circumstances, it is appropriate to grant leave to appeal. [ 3 ] Given the nature of the matters raised, the appeals should proceed by memoranda.
FOR THESE REASONS, THE UNDERSIGNED: [ 4 ] GRANTS leave to appeal; [ 5 ] AUTHORIZES the Petitioners to appeal from the judgment of the Superior Court, District of Montreal (the honourable David R. Collier) dated January 9, 2019; [ 6 ] ORDERS that the Applicants, after notifying the respondent, file with the Office of the Court, no later than April 30, 2019 , fives copies of the documents mentioned at
article 53 R.C.A.Q.C.M. and, if applicable, an argument of no more than 20 pages each by the Applicant Frederick Langford Sharp and the Applicants Shawn Van Damme et al;
[ 7 ] ORDERS that the Respondent, after notifying the Applicants, file with the Office of the Court, no later than June 14, 2019 , fives copies of the documents mentioned at
article 53 R.C.A.Q.C.M. and, if applicable, an argument of no more than 40 pages total for the two appeals; [ 8 ] REFERS the appeals to the Master of the Rolls to fix the hearing, for a duration of 90 minutes (45 minutes for the Applicants; 45 minutes for the Respondent); [ 9 ] With judicial costs to follow.
