Loi sur la protection de la jeunesse ) ______________________________________________________________________ MISE EN GARDE : La
Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d’identifier un enfant ou ses parents. Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.) [ 1 ] Invoquant l’article 70.1 de la
Loi sur la protection de la jeunesse , la Directrice de la protection de la jeunesse demande de nommer C, tutrice à la personne de X, âgé de six ans. La mère y consent. Le père n’assiste pas à l’audience ; il réside à Ville D, est absent de la vie de l’enfant et la Directrice a été dispensée de lui signifier la demande. [ 2 ] Selon l’article 70.1 de la
Loi sur la protection de la jeunesse , la nomination d'un tuteur exige une analyse en deux étapes. Le Tribunal doit d'abord vérifier si l'enfant se trouve dans l'une des situations énoncées à l'
article 207 C.c.Q. Pour que la demande soit recevable, l'enfant doit en effet se trouver dans l’une des trois situations suivantes : – être orphelin et ne pas avoir de tuteur – être un
enfant dont ni le père ni la mère n'assument, de fait, le soin, l'entretien ou l'éducation – être vraisemblablement en danger s'il retournait auprès de ses parents. Si cette première condition est respectée, le Tribunal doit ensuite décider si la tutelle est dans l'intérêt de l'enfant. [ 3 ] Or, en l'espèce, la preuve permet de conclure que l’enfant serait en danger s’il retournait vivre auprès de ses parents. [ 4 ] La Directrice prend la situation de X en charge depuis 2014, après que la mère ait été trouvée dans la rue, en état de psychose, berçant vigoureusement son fils nu.
Hébergée en famille d’accueil pendant cinq jours, l’enfant est par la suite confié à sa grand-mère qui en prend charge depuis le mois d’août 2014. En 2016, il reçoit un diagnostic de Trouble du spectre de l’autisme. [ 5 ] La mère a des problèmes de santé (diabète, dépression endométriose, anxiété et hypertension) qui l’empêchent de s’occuper à temps plein de son fils. Elle manque en effet d’énergie, a des difficultés de concentration et ressent souvent de vives douleurs. Elle le voit cependant presque toutes les fins de semaine.
Mais, c’est toujours pour elle un défi d’encadrer son fils et de s’astreindre à une routine. Elle reconnaît donc ne pas être capable de prendre charge de X sur une base quotidienne. [ 6 ] Par ailleurs, l’enfant a développé un lien significatif avec sa grand-mère, qui s’occupe aussi de Y, le frère aîné de X. Cette dernière est capable de rassurer l’enfant ; elle l’encadre, le surveille et le protège.
Elle collabore avec les différents organismes qui peuvent offrir des services à l’enfant, le [centre A], par exemple. [ 7 ] Le Tribunal conclut donc que la tutelle est dans l'intérêt de l'enfant. [ 8 ] POUR CES MOTIFS, LE TRIBUNAL : [ 9 ] ACCUEILLE la demande; [ 10 ] DÉFÈRE la tutelle à la personne de l'enfant X, né le [...] 2010 à Ville D, à C; [ 11 ] CONFIE l'enfant à la tutrice C; [ 12 ] AUTORISE la tutrice à consentir seule aux soins et services que l'état de santé de l’enfant requiert; [ 13 ] ORDONNE que les contacts entre l’enfant et ses parents soient selon entente avec la tutrice; [ 14 ] ORDONNE au greffe de la Cour du Québec, chambre de la jeunesse, de transmettre une copie du présent jugement au Curateur public; [ 15 ] LE TOUT sans frais. __________________________________ MARIE PRATTE, J.C.Q.

Every person who contravenes this provision is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [1] Invoking
section 70.1 of the Youth Protection Act , the Director of Youth Protection is requesting that C be appointed as tutor to the person of X, age six. The mother consented to this. The father did not attend the hearing. He lives in Town D and is absent from the child’s life. The Director was dispensed from serving the application on him. [2] According to
section 70.1 of the Youth Protection Act , the appointment of a tutor requires a two-stage analysis. The Court must first verify whether the child i s in one of the situations described in
article 207 C.C.Q. In order for the application to be admissible, the child must be in one of the following three situations: – be an orphan who has no tutor – be a child whose father and mother both fail, in fact, to assume his or her care, maintenance or education – be a child who in all likelihood would be in danger if he or she returned to his or her parents.
If that first condition is met, the Court must then decide whether tutorship is in the child’s interest. [3] In this case, the evidence makes it possible to conclude that the child would be in danger if he went back to live with his parents. [4] The Director has been in charge of X’s situation since 2014, when the mother was found on the street in a state of psychosis, vigorously rocking her nude son in her arms. The child stayed with a foster family for five days, after which he was entrusted to his grandmother, who has been caring for him since August 2014.
In 2016, the child was diagnosed with an autism spectrum disorder. [5] The mother has health problems (diabetes, depression, endometriosis, anxiety and hypertension) that prevent her from caring for her son on a full-time basis. She lacks energy, has difficulty concentrating and often feels severe pain. Although she sees her son almost every weekend, supervising him is still a challenge for her, as is following a routine. She therefore acknowledged that she is unable to take charge of X on a daily basis.
[6] Moreover, the child has developed a significant bond with his grandmother, who also cares for Y, X’s older brother. The grandmother is able to reassure the child. She supervises, monitors and protects him.
She cooperates with the various organizations that can provide services for the child, such as the [centre A]. [7] Accordingly, the Court concludes that tutorship is in the child’s interest. [8] THEREFORE, THE COURT : [9] ALLOWS the application; [10] CONFERS tutorship to the person of the child X, born on […], 2010 in Town D, on C; [11] ENTRUSTS the child to the tutor, C; [12] AUTHORIZES the tutor to consent alone to the care and services required by the child’s state of health; [13] ORDERS that contact between the child and his parents take place according to an agreement with the tutor; [14] ORDERS the office of the Court of Québec, Youth Division, to send a copy of this judgment to the Public Curator; [15] THE WHOLE without costs. __________________________________ MARIE PRATTE J.C.Q.
