LA COUR La demande d’autorisation d’interjeter appel de la condamnation est rejetée. The following is the judgment delivered by THE COURT (Orally) [1] On March 23, 2011, a judge of the Provincial Court found Edward Faulkner guilty of 39 counts of fraud (s. 380(1)( b )(
i) of the Criminal Code ) and not guilty of two other counts. Mr. Faulkner wants to appeal the conviction on grounds that raise questions of fact or questions of mixed law and fact. Section 675(1) ( a )(ii) requires him to first obtain leave to appeal. [2] In our view, the grounds Mr. Faulkner wishes to raise in his appeal essentially ask us to retry his case. However, as has been said many times before, such is not the role of a Court of Appeal. His application for leave to appeal is therefore dismissed. ____________________________________ M.E.L.
