Any person who contravenes this provision commits an offence and is liable to a fine (sections 9.2, 9.3 and 135 Y.P.A.). [ 1 ] The Director of Youth Protection submits a motion for revision of a decision rendered January 19, 2022, in which the Court entrusted X to a rehabilitation centre. [ 2 ] The DYP asserts that X needs to remain in a rehabilitation centre. [ 3 ] X agrees to remain in the rehabilitation centre in Town A because the social worker testifies that she could be returned to the [region A] as soon as January 2023. [ 4 ] The mother is present in court and announces that she will be moving to [region B] for a year.
She is ready to receive her daughter for visits. The DYP says that X will be flown to see her family. [ 5 ] X’s current plan is to prepare for attaining the legal age of majority. FOR THESE REASONS, THE COURT : GRANTS the present application; DECLARES that the security and the development of the youth X are still in danger pursuant to
section 38 f) (serious behavioural disturbance) of the Youth Protection Act ; REVISES the Court order rendered on January 19, 2022, in the present file; ENTRUSTS X to a rehabilitation centre until [...], 2023; AUTHORIZES that X reside in an apartment as soon as she has acquired the skills for autonomous living; ENTRUSTS X to her mother when she will reside in an apartment;
AUTHORIZES, in favour of X, contacts with her mother, upon agreement and according to the modalities set with the Director of Youth Protection; ORDERS that X and her mother participate actively in the measures ordered, namely the social follow-up, the rehabilitation services and X’s medical follow-up; ORDERS that X receive all the health services related to her situation, including a follow-up regarding her borderline personality disorder and that she take her medication as prescribed; ORDERS that a person who works for an establishment or organization provide aid, counsel and assistance to the youth X and her family, until [...], 2023 ; ENTRUSTS the situation of the youth to the Director of Youth Protection to see that the measures are carried out [1] . __________________________________ Lise Gagnon, J.C.Q.
