Every person who contravenes this provision is liable to a fine (ss. 11.2, 11.2.1 and 135 Y.P.A .). [ 1 ] In accordance with ss. 38 and 75 of the Youth Protection Act , the applicant has brought an application before the Court for the protection of X, born on [...], 2017. [ 2 ] She proposes that the child remain in a foster family, that certain conditions be placed on contact with her parents, and that various other protective measures be made applicable for a period of six (6) months. [ 3 ] The grounds raised are parental neglect (serious risk) and sexual abuse by the father (serious risk). [ 4 ] The father is absent but is duly represented by counsel. [ 5 ] Through her counsel, the mother admits several facts and agrees with the conclusions. [ 6 ] Mtre Claude Dostie was appointed counsel to the child (s. 80).
He is legally mandated to act on behalf of his client. [ 7 ] In addition to the mother’s admissions, her consent, and the testimony, a few documents were duly filed and complete the evidence. [ 8 ] From the evidence as a whole, the undersigned notes primarily that the parents have been in a relationship for about a year. The birth of their daughter, X, was not planned, but they claim that it was wanted. [ 9 ] We note that the parents have other children from other relationships. Each of these children lives elsewhere than with Mr. B and/or Ms.
A. [ 10 ] The relationship between these two (2) individuals is rife with conflict and violence. Over the last year they have separated and reconciled several times. When X was born, they were not ready to bring her home to their apartment since they did not have all the necessary equipment and the floor was littered with drug paraphernalia. [ 11 ] The father uses marijuana, speed, crack (though only occasionally with respect to the last two (2)), and alcohol. When the father is intoxicated, he is aggressive and violent (verbally, physically, taking it out on objects).
[ 12 ] Nevertheless, the father feels that the mother’s psychological instability is at the source of the conflict between them, as she can also be physically violent against him and throw things. [ 13 ] The mother stopped drinking during her pregnancy but is currently experiencing depression. She has suicidal thoughts and fears that she will act out against the baby, making some remarks on the subject. [ 14 ] In this context, X was entrusted to a foster family after living with her mother in a shelter for battered women. [ 15 ] Since then, the parents regularly visit the baby. Contact has gone well.
The mother is affectionate and knows how to respond to X’s basic needs. The father is, despite everything, adequate. [ 16 ] This man presents specific sexually related behaviours. [ 17 ] For example, when the case worker visits, he will answer the door in his underwear (or bare chested) while watching juvenile pornography, which he claims suitably meets his needs.
The mother confirms that the father consumes this type of pornography (she nodded her head in the courtroom). [ 18 ] Also, he often took out nude photos of an ex-girlfriend that he showed openly, claiming that he enjoyed looking at these pictures. [ 19 ] Finally, he was charged with a sexual offence involving a fourteen year-old (14) adolescent, allegedly soliciting services from her and drugging her in a wooded area.
He denies this. [ 20 ] In short, as Ms. [Social Worker 2], the father’s former caseworker for some of his other children (he has seven (7) from several different relationships), quite rightly states, the father’s principal difficulty is that he has serious issues with boundaries.
This is so determinative that X cannot be left alone with him. [ 21 ] In these circumstances, and considering s. 38.2 of the Act as well as the overriding facts adduced in evidence, the undersigned has no hesitation in declaring the safety and development of the child in danger on the ground of sexual abuse (serious risk) with respect to the father and neglect (serious risk) with respect to both parents. [ 22 ] The Court will grant some of the protective measures for the term suggested because they are supported by the evidence and are suitable to the child’s needs. [ 23 ] The application is founded in law; it is in the interest of the child and respects her rights.
FOR THESE REASONS, THE COURT: [ 24 ] GRANTS the motion in part; [ 25 ] DECLARES that the security and the development of the child are compromised because of the neglect of the parents (serious risk) and the sexual abuse by the father (serious risk); [ 26 ] ORDERS the execution of the following protective measures until September 6 th , 2018 :
a) That X be entrusted to a foster family ;
b) That X receives all the health services required by her state;
c) That the contacts between X and her father be supervised and according to an agreement between him and the social worker as for the other modalities;
d) That the contact between X and her mother be according to an agreement between her and the social worker and, in the absence of an agreement, the contacts shall be supervised and upon an agreement with the mother for the other modalities;
e) That the father receives, if he gives his consent, the services for a personal follow-up, parental abilities, drug addiction, anger/stress management;
f) That the mother, who gave her consent, be assessed for her mental health, implicates herself in some follows up for her parental abilities and anger/stress management;
g) That the parents participate actively with the measures ordered and collaborate with the social worker;
h) That the parents report, as required, of the means used to end the compromised situation;
i) That a person working within the CISSS[A] provides help, counsel and assistance to the child and her family, [ 27 ] ENTRUSTS the situation of the child to the Director of youth protection who shall then see that the measures are carried out. __________________________________ Line Gosselin J.C.Q.

Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.). [1] La demanderesse conformément aux articles 38 et 75 de la
Loi sur la protection de la jeunesse , saisit le Tribunal d’une Demande en protection de X, née le 27 décembre 2017. [2] Elle suggère que l’enfant demeure en famille d’accueil, voit ses parents selon certaines modalités ainsi que diverses autres mesures de protection applicables pendant six (6) mois. [3] Le motif invoqué est en lien avec la négligence des parents (risque sérieux) et l’abus sexuel du père (risque sérieux). [4] Le père est absent, mais dûment représenté par avocat. [5] La mère, par l’entremise de son avocat, admet plusieurs faits et consent aux conclusions. [6] Maître Claude Dostie est désigné avocat de l’enfant (art.80). Il agit en vertu d’un mandat légal pour sa cliente.
[7] Outre les admissions et le consentement de la mère ainsi que les témoignages, quelques documents sont déposés légalement et complètent la preuve. [8] De l’ensemble de celle-ci, la soussignée retient principalement que les parents sont en couple depuis un (1) an, environ. La naissance de leur fille X n’est pas planifiée, mais désirée disent-ils. [9] Rappelons que les parents ont d’autres enfants d’autres unions. Chacun de ces enfants vit ailleurs qu’auprès de monsieur B et/ou madame A. [10] Cela dit. Les relations entre ces deux (2) personnes sont conflictuelles et empreintes de violence.
Ils vivent ainsi plusieurs séparations et réconciliations au cours de la dernière année. D’ailleurs, à la naissance de X, ils ne sont pas prêts à l’accueillir à leur logement n’ayant pas tout le matériel requis alors que traînent sur le plancher des instruments liés à la consommation. [11] De fait, le père consomme du cannabis, des speeds, du crack (à l’occasion, dans ces deux (2) derniers cas) et de l’alcool.
Or, lorsque le père est en état de consommation, il est agressif et violent (verbalement, physiquement et s’en prend aux objets). [12] Cependant, le père estime que l’instabilité psychologique de la mère est la source des conflits entre eux alors que cette dernière peut aussi être violente physiquement à son égard et lancer des objets. [13] Quant à la mère, elle cesse sa consommation d’alcool pendant sa grossesse, mais vit actuellement une dépression.
Elle a des idées suicidaires et craint de s’en prendre à la petite exprimant certains propos, à ce sujet. [14] C’est dans ce contexte que X est placée en famille d’accueil après avoir vécu avec sa mère dans un refuge pour femmes violentées. [15] Depuis, les parents visitent régulièrement la petite. Les contacts se passent bien. La mère est affectueuse et sait répondre aux besoins de base de X. Le père est adéquat, malgré tout. [16] En effet, cet homme présente des comportements particuliers en lien avec la sexualité. [17] À
titre d’exemples uniquement, il se présente en sous-vêtements (ou torse nu) pour accueillir une intervenante sociale alors qu’il est à regarder de la pornographie juvénile, ce qu’il dit être approprié pour répondre à ses besoins.
D’ailleurs, la mère confirme que le père consomme ce type de pornographie (elle hoche la tête, en salle d’audience). [18] Également, il a souvent pris des photos d’une ancienne conjointe nue qu’il exhibait sans retenue disant aimer regarder ces photos. [19] Finalement, il fait l’objet d’une accusation en lien avec la sexualité impliquant une adolescente de quatorze (14) ans dont il aurait sollicité les services et qu’il a droguée dans un boisé, ce qu’il nie. [20] Bref, comme l’exprime avec justesse madame [Social Worker 2], qui a été l’intervenante du père, par le passé, dans le cas de certains de ses autres enfants (il en a sept (7), de plusieurs unions), la difficulté principale du père est qu’il présente de graves problèmes avec « les frontières ».
Cela est à ce point déterminant que X ne peut être laissée seule avec lui. [21] Dans ces circonstances et considérant l’article 38.2 de la Loi ainsi que les faits prépondérants mis en preuve, la soussignée n'a aucune hésitation à déclarer la sécurité et le développement de l’enfant compromis pour le motif d’abus sexuel (risque sérieux) dans le cas du père et pour celui de négligence (risque sérieux) dans le cas des deux (2) parents. [22] Quant aux mesures de protection, le Tribunal fera droit à certaines de celles-ci pour la durée proposée puisqu’elles sont amplement appuyées par la preuve et appropriées aux besoins de l’enfant. [23] La demande est fondée en droit; elle est dans l’intérêt de l’enfant et respecte ses droits.
POUR CES MOTIFS, LE TRIBUNAL : [24] GRANTS the motion in part; [25] DECLARES that the security and the development of the child are compromised because of the neglect of the parents (serious risk) and the sexual abuse by the father (serious risk); [26] ORDERS the execution of the following protective measures until September 6 th , 2018 :
j) That X be entrusted to a foster family ;
k) That X receives all the health services required by her state;
l) That the contacts between X and her father be supervised and according to an agreement between him and the social worker as for the other modalities;
