Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d’identifier un enfant ou ses parents.
Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.p.j.). [ 1 ] La demanderesse, Directrice de la protection de la jeunesse (DPJ), présente une demande en révision et prolongation de l’ordonnance rendue le 19 mars 2018. [ 2 ] La DPJ allègue que depuis le prononcé de l’ordonnance, des faits nouveaux sont survenus qui justifient de réviser et de prolonger cette ordonnance pour des motifs liés au développement de l’enfant dans sa famille d’accueil, à la situation de la mère et à ses capacités de répondre aux besoins de son enfant. [ 3 ] En conséquence, la DPJ recommande au Tribunal de maintenir l’enfant auprès de madame B, de retirer l’exercice de certains attributs de l’autorité parentale à la mère concernant les soins de santé de l’enfant, spécifiquement avec un ophtalmologiste, un pédiatre, une thérapie dite occupational therapy et sa vaccination.
Le tout jusqu’au 30 août 2019. [ 4 ] La mère est absente. [ 5 ] Le procureur de l’enfant, Me Marie-Josée Lavigeur, mentionne, après avoir entendu l’ensemble de la preuve, de même que le témoignage de l’intervenante sociale, qu’elle est en accord avec les recommandations de la DPJ. Situation de l’enfant [ 6 ] L’enfant est confié à madame B. [ 7 ] Elle se développe bien auprès de madame B.
Elle y reçoit réponse à ses besoins. [ 8 ] Depuis le mois d’août 2018, les allées et venues de la mère demeurent inconnues. [ 9 ] La mère ne s’est impliquée dans aucun processus en lien avec ses problèmes de consommation d’alcool. [ 10 ] La mère n’a participé à aucun programme thérapeutique. Mesures [ 11 ] L’enfant est très jeune. Elle est âgée d’un an et deux mois. [ 12 ] [Intervenante 1], personne autorisée par la DPJ, dans un rapport daté du 22 octobre 2018, analyse l’importance de l’intervention de la DPJ dans les termes suivants : Ms.
A had stated that she believed that she was ready to raise her daughter with the support of her extended family. She seemed to be
focused on making plans for herself and her daughter. Ms. A was looking at completing her high school certificate and in working. In regards to therapy, she remained resistant to the idea, believing that she did not need it and could “handle it” on her own. As well, she continued to minimize and/or deny the seriousness of her substance abuse issues despite her history. Even though she had stated more than once that she would follow through with getting some support. To date there has not been any collaborating information.
Despite making plans with the extended family to live with them and to parent X together; soon after they moved to a larger apartment, Ms. A announced that she would be living with her cousin in order to care for her, and then – according to Ms. B – left in mid-August. She seems to have alienated her family including her daughter, who she has not seen since she left in mid-August 2018. Given that X was premature, has a low Apgar score and had cocaine in her system, medically there remains a risk. However, she is meeting her developmental milestones and continues to make positive gains.
X seems to be bonding with her extended family, who are committed to caring for her on a long term basis. Ms. B is presently being assessed as a FAP home.
There is no father declared on the birth certificate and therefore there is no paternal extended family to consider at this time. [1] [ 13 ] L’intervenante sociale identifie les buts et objectifs visés par l’intervention, soit d’établir un plan permanent pour l’enfant, de lui permettre de vivre et d’évoluer dans un milieu où ses besoins développementaux sont rencontrés et qu’elle vive dans un milieu sécurisant. [ 14 ] Considérant l’âge de l’enfant, l’incapacité de la mère d’assumer les besoins de ce jeune enfant, le Tribunal conclut que les recommandations de la DPJ sont dans l’intérêt de l’enfant. [ 15 ] CONSEQUENTLY, THE COURT: [ 16 ] CONCLUDES that this application is well founded in facts and in law; [ 17 ] GRANTS the application; [ 18 ] DECLARES that the security and development of the child continue to be in danger for the reasons that were alleged; [ 19 ] THEREFORE: [ 20 ] ORDERS that the child be entrusted to the care of Ms.
B; [ 21 ] TAKES JUDICIAL NOTICE that Ms.
B is in the middle of a process to be accepted as a Proximity Foster home; [ 22 ] ORDERS that the frequency and modality of contacts between the child and her mother be determined by the Director of Youth Protection, including supervision for as long as deemed necessary, taking into account the commitment of the mother toward her child and the interest of the child; [ 23 ] WITHDRAWS from the mother the attributes of parental authority pertaining to the health needs of the child, namely eye doctor, regular pediatrician, occupational therapist and vaccination, and GRANTS the exercise of these attributes of authority to the Director of Youth Protection; [ 24 ] STRONGLY RECOMMENDS that the mother participate in a substance abuse assessment, and that she follow through with any recommendations arising from the assessment; [ 25 ] ORDERS that the mother not be under the influence of any substance while caring for the child; [ 26 ] ORDERS that the mother submit to random drug testing, as requested of the Director of Youth Protection; [ 27 ] ORDERS that aid, counsel and assistance be provided to the child and her family; [ 28 ] THE WHOLE until August 30, 2019; [ 29 ] ENTRUSTS the situation of the child, X, to the Director of Youth Protection of the Centre intégré universitaire de santé et de services sociaux A who shall then see that the measures are carried out.
