N o : 525-41-021010-087 DATE : 11 mars 2013 ______________________________________________________________________ SOUS LA PRÉSIDENCE DE : L’HONORABLE JUGE LUCIE GODIN, J.C.Q. ______________________________________________________________________ Dans la situation de l'enfant : X né […] 1999 [INTERVENANTE 1] , personne autorisée par la Directrice de la protection de la jeunesse La personne déclarante -et- A -et- B Les parents mis en cause ______________________________________________________________________ JUGEMENT ______________________________________________________________________ [ 1 ] À la demande et du consentement de toutes les parties, le Tribunal procède à une enquête commune dans la situation des enfants X, Y et Z. [ 2 ] Le 1 er novembre 2012, le Tribunal déclarait que la sécurité et le développement de l’enfant demeuraient compromis. [ 3 ] À la demande et du consentement de toutes les parties, le Tribunal rendait alors une mesure intérimaire et confiait l’enfant à sa mère. [ 4 ] Le Tribunal reportait l’audition au 11 février 2013; [ 5 ] Le 11 février 2013, M e Karine Dallaire soulignait au Tribunal qu’elle croyait que les enfants devaient être présents et ne pouvait, devant leur absence, exprimer leur position. [ 6 ] Du consentement de toutes les parties, le Tribunal reportait l’audience au 11 mars 2013. [ 7 ] L’intervenante sociale affirme, dans ses différents rapports, que la mère continue de collaborer avec les intervenants. [ 8 ] Depuis la dernière date d’audience, elle a maintenu une résidence stable, pour elle et ses enfants. [ 9 ] Le milieu de vie est adéquat pour la famille, propre et ordonné. [ 10 ] Il appert du rapport de l’intervenante que la mère est capable de gérer ses finances dans un contexte de stabilité. [ 11 ] Elle a, par ailleurs, communiqué avec l’intervenante sociale lorsque ses finances étaient plus difficiles et elles ont trouvé, ensemble, des plans pour trouver une solution. [ 12 ] Dans l’évaluation psychologique, les éléments suivants sont recommandés pour la mère et X [1] : « (…) Ms.
A as well as for X as a result of the information that was gathered during the assessment process. In regard to Ms. A recommendations included continued work with an educator, counselling at the CLSC, and engaging with her children in new ways to
change the family dynamics. In regard to X the psychologist has recommended a psychological assessment, as well as providing X more opportunities to take on positive responsibilities in the home to build trust and empower him. » [ 13 ] Dans la situation de X, il appert que sa situation soit la suivante [2] : « (…) he has continued to attend school on a regular basis however his late arrivals as well as his motivation in school have continued to be significant concerns.
X continues to be late on a daily basis and it was reported by the Vice Principal, [social worker 2] in January of 2013 that he often does not complete his work despite being kept late at school. Further, due to his lateness X misses entire classes at times. X has had some insight into the reasons for his lateness noting that he often has trouble getting up in the morning as a result of going to bed late the previous night. Despite his insight he does not appear to be motivated to change his behaviors and improve his late arrivals.
In regard to his participation in extra curricular activities X continues to be very involved in sports. During the winter months he has been involved in basketball and has also started track. In regard to X’s behaviors in the home there are some concerns. Since the last court date it has been noted that X has bullied Z in the home and often tests or disregards limits set by Ms. A. The educators have been working with Ms. A and X to alter these behaviors.
At the time of this report, there have been small changes in regard to a plan for X to have space in his room when he is struggling and in creating space for him to talk with his mother or Y when he is having issues at school or with friends. In January of 2013, Ms. A brought X to the hospital A because of pain in his chest. It was found that X has fluid in one of his lungs and has had some issues with his heart rate and dizziness. As the time of this report X is awaiting further testing scheduled for February 12, 2013, at the hospital. In the mean time, Ms.
A told this writer that X can participate in sports if he feels well.
However he has been advised to sit out if he feels ill and to use his inhaler before any participation. » [ 14 ] Tenant compte de la position exprimée par la mère, la preuve documentaire, la volonté et le désir des enfants exprimés par leur procureur, le Tribunal conclut que les recommandations sont dans l’intérêt de l’enfant. [ 15 ] PAR CES MOTIFS, LE TRIBUNAL : [ 16 ] ENTRUSTS X to his mother’s care; [ 17 ] ORDERS that mother complete a post recovery drug treatment program and follow the recommendations made; [ 18 ] ORDERS that mother submit to random drug testing upon the request of the worker; [ 19 ] ORDERS that mother be abstinent of drugs unless prescribed by a doctor; [ 20 ] ORDERS that X attends school regularly and arrive on time for classes through all the day; [ 21 ] ORDERS that mother and the child refrain from all form of verbal violence, specifically, the use of vulgar language in the home; [ 22 ] ORDERS that mother advise the delegate of any impending change of address 30 days prior to the move; [ 23 ] ORDERS that mother continue to collaborate with Director of Youth Protection; [ 24 ] ORDERS that the family follow through on the recommendations of the psychological assessment written by D r Sarah Fraser, including the recommendation that X complete a psychological assessment; [ 25 ] ORDERS that aid, counsel and assistance be provided to the child, his mother and family for a one (1) year period, as of today; [ 26 ] ENTRUSTS the situation of X to the DYP of A Youth and Family Centres. __________________________________ LUCIE GODIN, J.C.Q.
