Counsel at hearing: For the appellant: No one appeared For the respondent: Patrick McGuinty Avocats à l’audience : Pour l’appelant : personne n’a comparu Pour l’intimé : Patrick McGuinty THE COURT The application for the appointment of counsel, the motion to adduce evidence, and the application for leave to appeal sentence are dismissed.
The following is the judgment delivered by THE COURT (Orally) [ 1 ] Troy Bishop’s application to have counsel appointed, his motion to adduce evidence, and his application for leave to appeal the sentence imposed following his guilty plea are all dismissed. [ 2 ] Mr. Bishop applied for counsel to be appointed under s. 684 of the Criminal Code . At the outset of the hearing, his application was dismissed because, in our view, and for the reasons set out below, it is abundantly clear that, even with arguments by counsel, the Court would conclude there is no merit to Mr. Bishop’s appeal.
As a result, the interests of justice did not require the appointment of counsel in this case. [ 3 ] Mr. Bishop was charged with six criminal offences, the most serious of which were breaking and entering the home of his intimate partner (“the victim”) ( s. 348(1) (
b) of the Criminal Code ) and, several months later, assaulting her by striking and choking her ( s. 267 (c)). One of the other offences related to the destruction of the victim’s property on the date of the assault and the other three offences, to breaches of undertakings or orders to have no contact with the victim. In the Provincial Court, Mr. Bishop pled guilty to all charges. [ 4 ] At the sentencing hearing, the judge complied with s. 606 of the Criminal Code and ensured Mr. Bishop was aware of the consequences of his plea. The judge also confirmed Mr.
Bishop did not dispute any of the facts as described by the prosecution. For the six offences, the sentencing judge imposed a sentence of incarceration totalling 13.5 months, less six months for pre-sentence custody. [ 5 ] In his application for leave to appeal his sentence, Mr. Bishop alleges the legal aid lawyer who represented him at the sentencing hearing was ineffective. Mr.
Bishop claims the lawyer informed him that the prosecution would be seeking a sentence of incarceration from 11 to 13 months and that, because his lawyer would be arguing for less, he would likely receive a sentence close to time served because “[the Crown] never gets what they want or ask for.”
[ 6 ] Mr. Bishop filed a motion to adduce evidence on appeal, in the form of an affidavit in which he set out facts he claims demonstrate counsel’s ineffectiveness. The lawyer in question has filed an affidavit in response, denying the allegations set out in Mr. Bishop’s affidavit. [ 7 ] Evidence in support of a claim of ineffective counsel will only be admitted if (1) it is relevant to an issue before the Court, (2) it is credible, and (3) it is sufficient (if uncontradicted) to warrant making the order sought, that is, if it establishes the ground of ineffectiveness: Boucher v. R. , 2021 NBCA 36 , [2021] N.B.J.
No. 201 (QL) , per Quigg J.A., at para. 19, quoting from R. v. Dreaver , 2014 SKCA 113 , [2014] S.J. No. 729 (QL) . Mr. Bishop failed to meet this test. [ 8 ] It is not necessary for us to pronounce on the credibility of Mr. Bishop’s affidavit because, in our view, the third branch of the test has not been met. For an appeal to be successful on grounds of ineffective counsel, an appellant must show not only that his counsel was incompetent (the performance component), but also that a miscarriage of justice occurred as a result (the prejudice component). In the present case, Mr.
Bishop did not establish the latter component. He did not show that, but for the representation he received, he would have received a lesser sentence. [ 9 ] Three offences occurred on the same date. They were described to the sentencing judge as follows: [The victim] advised police that Mr. Bishop had been living with her since December 2021. She stated that he was in a better mood for about a month and then he started arguing with her again frequently. Note that Mr. Bishop was still on conditions not to be around [the victim] at this time.
She stated that he started to destroy her things, like putting holes in the wall, breaking various plants, and taking some vials of Botox that she had and smashing them. Each vial being valued at about $900. She stated that Mr. Bishop had been controlling lately and the previous night, March 6, 2022, [the victim] had come back to the residence with Mr. Bishop and they started arguing. [The victim] tried to go to sleep several times, but Mr. Bishop had been drinking and as he became more intoxicated, he started to become more aggressive with [the victim].
She told police that she was sitting on the couch in one end of the house when Mr. Bishop came over to her and took her phone away. And during this incident, Mr. Bishop punched [the victim] in the left shin, went over to the kitchen at the opposite side of the house. At that point [the victim] got up and went to get her phone back from him and took it out of his hands. He at that point came up behind her, wrapping his arm around her neck, lifting her off her feet, dragging her over to the couch. She stated that she could not breathe and he then threw her on to the couch. Mr.
Bishop got on top of her and pushed down on her neck, cutting off her ability to breathe. She stated that she attempted to get him off by slapping at him and hitting him with a drill she was able to grab. Mr. Bishop grabbed the TV remote, threw it at the television. Which broke the television. And at that point, he got—he removed himself from [the victim] and left on foot. [ 10 ] The sentencing judge asked Mr. Bishop whether he disputed any of those facts, to which Mr. Bishop replied: “No, Your Honour.” [ 11 ] For these offences, Mr. Bishop was sentenced to incarceration for a total of six months.
These terms would be consecutive to the six months imposed for his breaking and entering the victim’s home several months earlier and to consecutive sentences of 15 days and one month for violating conditions requiring him not to have any contact with the victim. [ 12 ] In passing sentence, the judge twice remarked that, had the prosecution sought a lengthier term of incarceration, he might have imposed it. The judge emphasized the seriousness of intimate partner violence. To the extent the judge was communicating the prosecution’s recommendation was on the lenient side, we agree.
No miscarriage of justice occurred in this case. [ 13 ] Since Mr. Bishop was unable to satisfy the prejudice component, it followed his appeal, based on an allegation of ineffective counsel, had no chance of success. As a result, both his motion to adduce evidence and his application for leave to appeal the sentence were dismissed.
19, citant R. c. Dreaver , 2014 SKCA 113 , [2014] S.J. No. 729 (QL). M.
