Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d’identifier un enfant ou ses parents. Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.). [ 1 ] Le Tribunal est saisi d'une requête au sens de l'article 38 b) 1) iii) et 2) de la
Loi sur la protection de la jeunesse concernant X, âgée de 8 ans. [ 2 ] La Directrice de la protection de la jeunesse allègue que l'enfant est victime de négligence au plan éducatif. L'enfant fut retirée de l'école au mois de janvier 2015 par sa mère. [ 3 ] Cette dernière aux prises avec des difficultés importantes au plan financier a quitté son appartement. Elle s'est retrouvée sans domicile fixe comptant sur la générosité d'un ami pour obtenir une chambre. [ 4 ] Cette personne, un dénommé C, a demandé par la suite l'expulsion de la mère.
Celle-ci et l'enfant se sont réfugiés dans une remise située dans la cour arrière de l'appartement de cet individu. [ 5 ] La mère a dû quitter les lieux par la suite. Elle s'est finalement retrouvée réfugiée dans un hôtel appartenant à un ami. Ce dernier ayant rencontré la mère par le biais de la communauté bouddhiste de la région. Elle réside depuis le 20 mai dernier sur une base temporaire à cette auberge. [ 6 ] Ce déménagement a entraîné un changement de ville une fois de plus, l'enfant devait donc être intégrée au sein d'une nouvelle école.
Or, la mère a négligé d'effectuer les démarches requises pour assurer la scolarisation de l'enfant. Depuis la maternelle, l'enfant a changé d'école à quatre reprises compte tenu du mode de vie improvisé de sa mère. [ 7 ] La preuve révèle que la situation personnelle de la mère est pour le moins nébuleuse. La mère énonce une multitude de projets susceptibles de la conduire dans diverses villes au travers le Canada. Elle caresse parfois le projet de retourner dans sa province d'origine [dans la province A]. La mère se soucie bien peu de l'impact de son mode de vie sur l'enfant.
[ 8 ] L'audition de ce dossier a débuté le 22 juillet 2015. Le Tribunal a choisi de poursuivre l'enquête sur les mesures applicables au 26 août 2015 afin d'obtenir un portrait global de la situation notamment au plan scolaire. [ 9 ] Le Tribunal exigeait de plus que la mère effectue une démarche afin d'inscrire l'enfant à une école de la région compte tenu de l'imminence de la rentrée scolaire. La mère devait de plus fournir l'extrait de naissance de l'enfant. [ 10 ] Or, la mère a fait défaut une fois de plus d'inscrire l'enfant à l'école.
La Cour a dû confronter la mère à un ultimatum afin qu'elle inscrive et permette à l'enfant de débuter l'école. [ 11 ] Depuis le printemps dernier, la mère énonce qu'elle veut procéder à la scolarisation à domicile de sa fille. La mère n'a obtenu aucune des autorisations requises de la commission scolaire ou du ministère de l'éducation pour actualiser ce projet. [ 12 ] Ce jour, la Directrice de la protection de la jeunesse requiert le maintien de l'enfant auprès de la mère.
Elle sollicite la collaboration de la mère dans le cadre du suivi psychosocial notamment qu'elle lui fasse rapport périodiquement de sa situation. [ 13 ] Elle réclame de la mère qu'elle prenne les moyens pour permettre à l'enfant de fréquenter l'école de façon assidue.
Elle considère nécessaire d'intervenir auprès de la mère et de l'enfant sur une période s'échelonnant jusqu'à la fin des classes au mois de juin 2016. [ 14 ] La mère témoigne qu'elle veut retourner auprès des membres de sa famille [dans la province A] alors qu'il y a à peine quelques semaines elle caressait le projet d'un emploi dans la région A. [ 15 ] Bref, l'enfant ne peut demeurer à la merci des projets tous plus aléatoires les uns que les autres de la mère. [ 16 ] Les mesures préconisées par la Directrice de la protection de la jeunesse sont dans l'intérêt de l'enfant. [ 17 ] De l'avis du Tribunal la période ciblée doit cependant être plus longue.
L'enfant a connu beaucoup d'instabilité et n'a pu compléter son année académique. Il sera pertinent de s'assurer qu'elle puisse non seulement cette année mais également poursuivre sa scolarisation à l'automne 2016. [ 18 ] La filiation paternelle de l'enfant est connue. La mère témoigne toutefois que le père n'est pas impliqué dans la vie de sa jeune fille depuis les premiers mois de la naissance de l'enfant. [ 19 ] La mère soutient qu'elle peut par contre compter sur son milieu familial pour lui venir en aide.
Elle a l'intention de reprendre contact avec ces derniers afin d'obtenir leur support. [ 20 ] La mère nous assure également de sa pleine collaboration au cours des prochains mois. [ 21 ] La mère pourra, si elle concrétise ses projets [dans la province A] en privilégiant pour ce faire une période de l'année susceptible de pénaliser le moins possible l'enfant, tel la période des Fêtes, présenter une requête en révision par anticipation de cette décision. [ 22 ] Il faudra cependant en pareil cas que la mère garde à l'esprit que la fréquentation scolaire et la stabilité à long terme d'un milieu de vie pour l'enfant demeureront un enjeu prioritaire.
La mère devra donc à l'avenir prendre des décisions en tenant compte de ces deux facteurs. [ 23 ] POUR CES MOTIFS, LE TRIBUNAL: [ 24 ] GRANTS the motion; [ 25 ] DECLARES that the security and the development of the child X are in danger for the following reason: ― 38 b) 1) iii) : neglect on educational level; [ 26 ] ORDERS that the child X remain with her mother and that the mother report periodically to the Director of Youth Protection on the measures she applies to put an end at the situation of compromission; [ 27 ] ORDERS that a person working for an institution or body provide aid, counseling or assistance to the child X and her family for a period of one (1) year; [ 28 ] ORDERS that the mother of the child X take an active
part in the application of the measures ordered; [ 29 ] ORDERS that the mother assure that the child goes to school assiduously; [ 30 ] ENTRUSTS the situation of the child X to the Director of Youth Protection A for the execution of the present judgment. __________________________________ JOHANNE DENIS, J.C.Q. Every person who contravenes this provision is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [1] The Court is seized of a motion under sections 38( b )(1)(iii) and (2) of the Youth Protection Act as concerns X, 8 years old. [2] The Director of Youth Protection alleged that the child is the victim of neglect from an educational standpoint. In January 2015, the mother withdrew her from school. [3] The mother, who had serious financial problems, left her apartment.
She found herself with no fixed address and counting on the generosity of a friend for a room. [4] That person, a man named C, subsequently asked the mother to leave. She and the child sought refuge in a shed located in the backyard of the individual’s apartment. [5] Later, the mother had to leave the premises. She finally took refuge in a hotel belonging to a friend. That friend had met the mother through a Buddhist community of the region. She has been living in that inn on a temporary basis since May 20.
[6] That move resulted in a change of city once more, and the child had therefore to be enrolled in a new school. But, the mother has failed to take the steps required for the child to attend school. Since kindergarten, the child has changed schools four times given the improvised nature of the mother’s lifestyle. [7] The evidence shows that the mother’s personal situation is nebulous, to say the least. The mother stated a multitude of plans likely to take her to various cities across Canada. She sometimes plans to return to her home province, [province A].
The mother cares very little about the impact her lifestyle has on the child. [8] The hearing of this case began on July 22, 2015. The Court chose to continue the hearing on the applicable measures on August 26, 2015 in order to obtain an overall picture of the situation, particularly from the standpoint of the child’s schooling. [9] The Court also required that the mother take steps to enroll the child in a local school given that the school was to begin shortly. In addition, the mother was to provide the child’s birth certificate. [10] But, the mother failed once more to enroll the child in school.
The Court had to give the mother an ultimatum whereby she was to enroll the child in school and allow her to start. [11] Since last spring, the mother has been saying that she wants to home school her daughter. The mother has not obtained any of the authorizations required from the school board or the ministère de l’Éducation to do so. [12] At the hearing, the Director of Youth Protection sought to have the child remain with her mother.
She asked that the mother cooperate in the psychological follow-up, in particular, that she periodically report to her on the situation. [13] She requested that the mother take the steps to enable the child to attend school regularly.
She considered it necessary to intervene with the mother and the child until the end of the school year, in June 2016. [14] The mother testified that she wants to return near the members of her family in [province A], whereas, only a few weeks ago, she was planning to find a job in the region A. [15] In short, the child cannot remain subject to the mother’s plans, each one more uncertain than the last. [16] The measures advocated by the Director of Youth Protection are in the child’s interest. [17] In the Court’s opinion, the period sought should be longer however.
The child has experienced great instability and could not complete her school year. It will be appropriate to ensure that she goes to school on only this year but also in the fall of 2016. [18] The child’s paternal filiation has been known. However, the mother testified that the father has not been involved in his young daughter’s life since the first months of her life. [19] However, the mother contends that she can count on her family members to help her.
She intends to resume contact with them in order to get their support. [20] The mother also assured us that she would fully cooperate in the coming months. [21] If she makes her plan to move to [province A] a reality by giving priority to a period of the year likely to penalize the child as little as possible, such as the Christmas holidays, the mother can file an application for early review of this decision. [22] In such a case, however, the mother will need to keep in mind that school attendance and long-term stability regarding the child’s living environment will remain a priority.
Therefore, the mother will need to make future decisions by taking those two factors into account.
