Z) Parents - intimés JUGEMENT [1] JH5272 (Art. 95 L.P.J.) [ 1 ] Le Tribunal est saisi d'une demande en révision d'une ordonnance rendue par le soussigné le 30 mars 2015. [ 2 ] Le Directeur considère que son intervention est requise pour encore quelques mois afin de permettre aux parents d’obtenir des services du CLSC de leur quartier. Les parties consentent aux mesures proposées. [ 3 ] La mère améliore tranquillement son sort. Elle participe à un processus thérapeutique auprès du Pavillion Foster. Elle n'utilise plus de moyens de discipline physique. Elle continue d’être suivie par son médecin de famille.
Elle prend sa médication. [ 4 ] Le père observe certains changements positifs chez les enfants. X et Y sont moins difficiles à contrôler. Z souffre encore de problèmes de comportement inquiétants. [ 5 ] Néanmoins, toute la famille reçoit le support d'un éducateur et d'une travailleuse sociale du CLSC de St-Michel. Le conflit entre les parents perdure bien que ceux-ci fassent des efforts évidents pour s'assurer que les enfants n'en subissent les conséquences. [ 6 ] Le Tribunal constate donc que la famille évolue lentement mais positivement.
Les services de la Direction de la protection de la jeunesse ne devraient plus être requis pour très longtemps. FOR ALL THESE REASONS, THE COURT: [ 7 ] GRANTS the motion; [ 8 ] DECLARES that security and development of the children are still compromised; [ 9 ] ENTRUSTS the situation of the children to the Director of Youth Protection A, who shall then see that the measures are carried out: [ 10 ] ORDERS that Y and X remain entrusted to the care of their father; [ 11 ] ORDERS that Z be entrusted to the care of Mr. A;
[ 12 ] ORDERS that contacts between the children and their mother take place following modalities to be established by the Director at a frequency to be agreed upon between the parties; [ 13 ] TAKES ACT that the parties have prepared a
schedule for the summer; [ 14 ] SUSPENDS the contacts between Z and his father; [ 15 ] RECOMMENDS the mother to follow the recommendations of her treating professionals to address her substance abuse and mental health issues; [ 16 ] RECOMMENDS to the parents to engage in individual counselling; [ 17 ] TAKES ACT of the family's commitment to participate with services provided by the CLSC St-Michel; [ 18 ] ORDERS the parents to collaborate with the Director of Youth Protection; [ 19 ] ORDERS that aid, counsel and assistance be provided to the children and their parents; [ 20 ] THE WHOLE for 7 months .
