Counsel at hearing: Gabriel Joseph Richardson on his own behalf For the respondent: Patrick McGuinty Avocats à l’audience : Gabriel Joseph Richardson en son propre nom Pour l’intimée : Patrick McGuinty THE COURT The application for leave to appeal both conviction and sentence is dismissed. The following is the judgment delivered by THE COURT [ 1 ] On November 13, 2019, Gabriel Joseph Richardson was convicted of breaking and entering ( s. 348(1) (
b) of the Criminal Code ), resisting arrest ( s. 129 (a)), failure to comply with an order of the court ( s. 145(3) (a)) and breaching an undertaking given to a police officer ( s. 145(5.1) ). On November 15, 2019, he was sentenced to 14 months’ imprisonment. [ 2 ] Mr. Richardson wishes to appeal both conviction and sentence. Since none of the grounds raised allege an error of law, he requires leave: s. 675(1)(a)(ii) and s. 675(1)(b). [ 3 ] Essentially, Mr. Richardson asks us to make fresh findings of credibility and fact, which would amount to this Court retrying the case.
As we have often stated, that is not our role. Such findings are entitled to deference and may not be overturned unless the result of a palpable and overriding error ( Nowlan-Ward v. R. , 2020 NBCA 41 , [2020] N.B.J. No. 133 (QL) ). [ 4 ] Having reviewed the record, we conclude there would be no reasonable prospect of success on appeal if leave were granted. This is so in regard to both conviction and sentence. As a result, the application for leave to appeal is dismissed.
R. , 2020 NBCA 41 , [2020] A.N.-B. n o 133 (QL) ).
