Counsel at hearing: For the appellant: No one appeared For the respondent: William B. Richards Avocats à l’audience : Pour l’appelant : Aucune comparution Pour l’intimé : William B. Richards THE COURT The application for leave to appeal is allowed. The victim fine surcharge is set aside and the sentence is otherwise confirmed. The following is the judgment delivered by THE COURT (Orally) [ 1 ] Cody Jordan McKillop was convicted of: (1) having broken and entered into a dwelling house with intent to commit an indictable offence ( s. 348(1) (
a) of the Criminal Code ); and (2) failing to comply with a probation order ( s. 733.1 ). The charges arose out of his unlawful break into the apartment of a woman with whom he had had a relationship. In the apartment, Mr. McKillop caused approximately $6,000 worth of damage. [ 2 ] Following Mr. McKillop’s admission of guilt in the Provincial Court, a judge sentenced him to incarceration for eight months for the break and enter offence and thirty days for the breach of probation, to be served concurrently.
Restitution of $5,990 was ordered to be paid and a one-year period of probation was to follow the incarceration. Some corollary orders were also made. In addition, Mr. McKillop was ordered to pay a victim fine surcharge of $200. [ 3 ] Mr. McKillop seeks leave to appeal the custodial portion of his sentence. He did not attend Court on the date set for hearing his application. Counsel for the Attorney General opposes the application although he recognizes the victim fine surcharge should be set aside on the authority of R. v. Boudreault , 2018 SCC 58 , [2018] S.C.J.
No. 58 (QL) . [ 4 ] But for the Crown’s position regarding the victim fine surcharge, we see no basis for appellate intervention and would normally have dismissed the application for leave to appeal. However, in light of this concession, we grant leave but affirm the sentence and all orders made except for the victim fine surcharge, which we set aside.
Boudreault , 2018 CSC 58 , [2018] A.C.S. n o 58 (QL) .
