Defendant ______________________________________________________________________ JUDGMENT ______________________________________________________________________ [ 1 ] A contract for television services intervened between the parties. [ 2 ] Plaintiff alleges that defendant "overcharged (her) for the service for the amount of $273.99. [ 3 ] Plaintiff also alleges that she sustained damages in the amount of $2,226.01, as a result of defendant's alleged omission. [ 4 ] Plaintiff had the burden of proof ( articles 2803 and 2804 of Civil Code of Quebec ). [ 5 ] There is no preponderant evidence that defendant breached its contractual obligations towards plaintiff. [ 6 ] Accordingly, defendant cannot be held liable for the requested compensation.
