P-34.1) WARNING: The Youth Protection Act forbids the publishing or broadcasting of information allowing for a child or the child’s parents to be identified. Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] The Director of Youth Protection asks the Court to review the last decisions made on January 22 nd 2015 concerning the child, X. [ 2 ] The child was entrusted to a foster family.
The Director now asks that the child remain with her foster family until she reaches the age of majority. [ 3 ] The parents admit most of the alleged facts and consent to the measures proposed by the Director. [ 4 ] The father does agree that the child be maintained in foster care but does not believe that she really wants to stay there until she reaches majority. [ 5 ] The child is now 13 years old. She had discussed with her lawyer and had stated that she wanted to stay with her foster mother until her majority. [ 6 ] The father came out of detention in July 2015.
He informed the social worker during the month of September 2015 that he did not want to be involved in the child’s life. [ 7 ] The mother still has a drinking problem. She does not want to stop or seek help. The mother does not have a residence of her own. FOR ALL THESE REASONS COURT: [ 8 ] GRANTS the motion;
[ 9 ] DECLARES that the security and development of the child, X, are still in danger; [ 10 ] REVISES and EXTENDS the decision rendered on January 22 nd 2015; [ 11 ] ORDERS that the child be entrusted to a foster family, namely that of Ms C; [ 12 ] ORDERS that the parents remain sober in the presence of the child; [ 13 ] ORDERS that the contacts between the child and the parents be determined by the Director of Youth Protection as to the modalities, the frequency and the degree of supervision; [ 14 ] ORDERS that a person working for an establishment or body provide aid, counsel and assistance to the child and the family; [ 15 ] ORDERS the police to collaborate to the execution of the enactment; [ 16 ] ENTRUSTS the situation of the child, X, to the Director of Youth Protection for the execution of the measures; [ 17 ] THE WHOLE until [...] 2020. __________________________________ JEAN GRAVEL, J.Q.C.
