LA COUR La Cour rejette l’appel et la demande d’autorisation d’appel. The following is the judgment delivered by THE COURT [ 1 ] On July 20, 2011, a judge of the Provincial Court convicted Peter Richard Higgins of two assaults under s. 266 (
a) of the Criminal Code , one assault with a weapon ( s. 267 ( a )), two sexual assaults ( s. 271(1) ( a )) and uttering threats ( s. 264.1(2) ( a )), for which he was sentenced to a global term of imprisonment of five years and nine months, in addition to time served pending sentencing. [ 2 ] Mr. Higgins appeals from his convictions pursuant to s. 675(1)( a )(
i) and seeks leave to appeal conviction and sentence pursuant to ss. 675(1)( a )(ii) and 675(1)(
b) respectively. He also applies for the assignment of state funded counsel pursuant to s. 684 of the Code . [ 3 ] In view of Mr. Higgins’ apparent familiarity with the court processes, the nature of the grounds of appeal and a lack of information regarding his financial circumstances, his application for the assignment of state-funded counsel is dismissed. [ 4 ] There is no merit to the appeal based upon any ground of appeal that involves a question of law alone. Mr. Higgins’ application for leave to appeal from conviction based upon a question that involves a question of fact or mixed law and fact is dismissed. Similarly, his application to appeal against the sentence passed is dismissed.
[ 5 ] The appeal and the application for leave to appeal are dismissed. ________________________________ J.T. ROBERTSON, J.A. ________________________________ B. RICHARD BELL, J.A. ________________________________ KATHLEEN A. QUIGG, J.A.
