[SOCIAL WORKER 1] Requérant et A B parents et La commission des droits de la personne et des droits de la jeunesse. Mise-en-cause J U G E M E N T (article 38) [ 1 ] Conformément à l'article 38 de la
Loi sur la protection de la jeunesse, le Tribunal est saisi d'une demande visant à faire déclarer que la sécurité et le développement de X sont compromis pour les motifs apparaissant au paragraphe de la requête. [ 2 ] De consentement et pour valoir preuve, la Directrice de la protection de la jeunesse a versé au dossier différentes pièces (D-2 à D-5), tel qu'il appert au procès-verbal de l'audience. [ 3 ] La mère, par son avocat, admet l’ensemble des allégations contenues à la requête et se dit en accord avec les mesures recherchées par la Directrice. [ 4 ] L'enfant, par son avocate, ignore l’ensemble des allégations contenues à la requête et se dit en accord avec les mesures recherchées. [ 5 ] La Directrice de la protection de la jeunesse allègue que la sécurité et le développement de l'enfant sont compromis pour les raisons suivantes: • On July 9, 2010, the Director of Youth Protection signed voluntary measures with all the parties; • On August 13, 2010, the child told a teacher from [center A] that his father hits him;
• A new signalment came out in physical abuse since the child reported that the father hit him with a lunch bucket; • The father has refused to address this new situation with the caseworker and with [center A]; • The father is not involved with the child since the new signalment, but was involved prior to the new signalment; • The mother is in agreement with the measures suggested; • The mother is collaborating with the caseworker and participating to the voluntary measures. [ 6 ] The mother admitted all the facts alleged by the Director of Youth Protection concerning her son. [ 7 ] The father did not appear in Court.
The Director made all necessary effort to inform him that we were to proceed in the situation of X. [ 8 ] X is in the middle of a parental conflict since at last a year. [ 9 ] The mother has shown real improvement in her personal situation and his capable of responding to the needs of her child. [ 10 ] X has shown since a couple of months that he can act in a more appropriate manner. The child was very aggressive in his schooling facility. [ 11 ] The father did not collaborate with his social delegate in the last months.
The child has declared in august that his father hit him with his lunch box. [ 12 ] Mr. [social worker 1] working for the social agency, knows the father from prior involvement. He tried to clarify this situation with the father. [ 13 ] The father never responded to the demands of Mr. [social worker 1]. [ 14 ] The security and development of the child are in danger under paragraph 38 b) & d)2) of the Youth Protection act. [ 15 ] THEREFORE, THE COURT: [ 16 ] DECLARES the security and development of the child in danger under paragraph 38
b) et d)2) of the Youth Protection; [ 17 ] ENTRUSTS the child to the care of her mother Ms. A; [ 18 ] ORDERS Ms. A continues with the integrated services through [center A] and that this progress is periodically reviewed with the [organization A] delegate; [ 19 ] ORDERS Mr. B take an active
part in the investigation of the outstanding allegations that he has hit his son with a lunch box; [ 20 ] ORDERS Mr. B's contact with X be restricted to agreement by all parties and only after he has taken
part in the investigation concerning the allegations of physical abuse reported on August 13 th , 2010, these contacts and in the presence of a third person designated by the Director of the Youth protection; [ 21 ] ORDERS parents report periodically to the delegate of youth protection; [ 22 ] ORDERS that person working for an institution or body provide aid, counselling or assistance to the three children and their family; [ 23 ] ALL these measures are rendered for a period of six months; [ 24 ] ENTRUST the situation of the chid to the Director of the Youth Protection of le Centre jeunesse A for the execution of the measures; [ 25 ] THE WHOLE WHITOUT COST. __________________________________ JEAN GRAVEL, juge Cour du Québec Chambre de la jeunesse M e Annick Bergeron Procureure de la DPJ
