Mélanie Camiré, Clerk at the hearing JUDGMENT [ 1 ] I am tasked with the decision of a motion entitled "Motion for permission to prepare for hearing at the Barreau du Québec with Me Sanderson and Michael Lacoste-Methot". [ 2 ] The motion is in effect a request to modify one of the conditions of release on bail of the Appellant imposed by judgment of Mr. Justice Martin Vauclair on December 14, 2018, that is: 8. “Ne pas communiquer ou tente de communiquer de quelque façon que ce soit avec :
a) les co-accusés […] Michael Lacoste-Methot […] sauf en présence de son avocat pour la préparation de son dossier d’appel." [ 3 ] According to the allegations of the motion, Mtre Sanderson is the object of a disciplinary proceeding before the Barreau du Québec involving her having communicated with the aforementioned co-accused.
She was declared to be in conflict of interest by judgment of the Court of Québec (the honourable Marco Labrie – 500-01-127883-187) on December 11, 2007 since both individuals are co-accused. [ 4 ] She seeks a modification of Appellant’s bail conditions so that he may be in the presence of said co-accused together with Mtre Sanderson in order to prepare for the disciplinary hearing.
Mtre Sanderson informs me that the hearing scheduled for September 28, 2020 has been postponed to a later date and since the Appellant’s appeal will be heard in October, this motion may become moot. [ 5 ] The Respondent contests the motion. [ 6 ] The motion is not supported by Appellant’s affidavit as required by Rule 31 but rather by the affidavit of Mtre Sanderson.
Moreover and more significantly it is by no means clear as to why (as Respondent indicates) Mtre Sanderson does not simply meet each of the two individuals separately in order to prepare for the disciplinary hearing. [ 7 ] The burden is the Appellant’s to satisfy the undersigned that the modification of the condition is warranted but I see no reason to grant the motion. FOR ALL THE FOREGOING REASONS, THE UNDERSIGNED: [ 8 ] DISMISSES the motion for permission to prepare for hearing at the Barreau du Québec with Me Sanderson and Michael Lacoste-Methot.
