JUDGMENT [ 1 ] The appellant appeals a judgment rendered on February 1, 2017 by the Honourable Mr. Justice Pierre Nollet of the Superior Court, District of Montreal, condemning her to pay to the respondent an amount of $65,933.60 together with interest and the additional indemnity as of August 20, 2014.
The appeal also challenges two other decisions rendered orally at the beginning of the trial on December 14, 2016 (with revised transcripts of these decisions issued on March 3, 2017), the first dismissing her request for a postponement of the trial and the second further dismissing a subsequent oral request for her attorneys to cease representing her in the case. [ 2 ] Although the appellant filed an appeal brief, her attorneys subsequently ceased to represent her in this appeal by notice dated August 9, 2018.
The appellant failed to appoint another lawyer or to indicate her intention to represent herself, even though she was notified to do so by the respondent at her last known address. The respondent consequently requested that the appeal be heard pursuant to
section 30 of the Civil Practice Regulation (Court of Appeal) (the “Court’s Rules”). Although the Court’s Rules do not require it, the appellant was sent a notice of the scheduled hearing date at her last known address by registered mail, which notice was not claimed, and by regular mail, which notice was returned to the sender. [ 3 ] Under
section 30 of the Court’s Rules, the appeal may be conducted in the absence of the party that fails to file either a representation statement by counsel or a non-representation statement. [ 4 ] The crux of the appellant’s argument in her appeal brief is that the trial judge erred in law by refusing her request for a postponement of the trial. She argues that this refusal was a breach of procedural fairness since her new attorneys were not ready to proceed to trial.
The appellant thus seeks to have the judgment on the merits quashed and a new trial ordered. [ 5 ] We are unanimously of the view that, in the circumstances of this case, the appellant’s arguments have no merit. The underlying proceedings in this case are a simple claim for payment for services rendered to the appellant in 2013. The appellant requested an inordinate amount of time, three trial days, to defend against this claim, thus delaying the trial to December 2016.
After the trial dates had been set by the Superior Court, she dismissed her lawyer at the time, Mtre Brière, in June 2016 in order to be represented by the firm of Dunton Rainville, which was then handling other legal matters for her. Mtre Brière physically transferred the appellant’s file to the firm of Dunton Rainville on September 13, 2016. [ 6 ] However, for reasons which the trial judge found to be tied to an advance on Dunton Rainville's fees, that firm only officially accepted the mandate on December 9, 2016, a few days before the scheduled trial dates.
The appellant’s new attorneys then sought a postponement of the trial on the ground that they were not ready to proceed. [ 7 ] The trial judge refused the postponement for the following reasons: [11] De l’avis du Tribunal, Dunton Rainville a la « saisine » du dossier depuis le 13 septembre 2016. Le cabinet n’a rien fait pour préparer l’audition ou pour se dessaisir du dossier. [12] Les avocats ont certes droit de demander des avances pour représenter un client. Toutefois, ils ne peuvent prendre le système judiciaire, l’autre
partie et leur client en otage, en assujettissant une demande de substitution de procureurs, à une demande de remise. [13] Le nouveau Code de procédure civile dans les dispositions préliminaires, rappelle l’importance d’assurer l’accessibilité, la qualité et la célérité de la justice civile.
L’exercice des droits des parties doit se faire dans un esprit de coopération et d’équilibre. [14] Dans les principes directeurs de la procédure, le législateur requiert que les juges, dans la gestion de chacune des instances qui leur sont confiées, prennent des décisions qui tiennent compte de la bonne administration de la justice. Chaque année, plus de 50 000 dossiers sont ouverts en Cour supérieure. Il n’y a que 190 juges pour les entendre. [15] Accorder une demande de remise parce que la
partie en défense ou ses procureurs se sont trainé les pieds ou ont tardé à se préparer, empêche le Tribunal d’entendre d’autres justiciables. La salle, le greffier, l’huissier et le juge ont tous été mis à la disposition des parties avec des mois de préavis. D’autres justiciables ne peuvent être entendus ou être appelés au pied levé pour les remplacer. Il faut donc, pour qu’une remise soit accordée, qu’elle fasse valoir des motifs très sérieux.
Malgré toute la bonne foi d’une partie, celle-ci ne serait pas en mesure de procéder. [16] En choisissant de demander une substitution de procureurs la veille d’un procès, les avocats acceptent par implication les décisions de gestion qui interviennent par la suite comme tout autre procureur dans les mêmes circonstances. Ils ne peuvent se prémunir en disant que leur demande est conditionnelle à l’obtention d’une remise. [17] Les parties n’ont pas un droit automatique à une demande de remise, il faut des motifs sérieux. [18] En contrepartie, les parties ont droit à une audition dans un délai raisonnable.
Il arrive un moment où le retard constitue un déni de justice comme l’a déjà noté la juge St-Pierre en citant plusieurs décisions dans l’affaire Musique et divertissement Grand Gemine . [19] Une audition, même réduite à deux jours, ne pourra avoir lieu, dans le meilleur des cas, avant le milieu ou la fin de 2017. C’est près de quatre ans après que les services auront été rendus. (References omitted) [ 8 ] Following that decision, the appellant’s new lawyers sought to cease representing her.
The trial judge refused that request on the ground that it was a dilatory tactic: [5] CONSIDÉRANT que la défenderesse apparait ici, utiliser une mesure dilatoire qui vise à empêcher la tenue du procès;
[6] CONSIDÉRANT que les avocats Dunton Rainville ont la « saisine » du dossier depuis la 13 septembre 2016 et qu’ils ont eu tout le loisir de le préparer ou de s’en dessaisir, ce qu’ils n’ont pas fait avant ce jour; [7] CONSIDÉRANT qu’ils ont eux-mêmes demandé ce jour, la permission de se substituer au procureur antérieur assortie, il est vrai, d’une demande de remise qui a été refusée; [8] CONSIDÉRANT que la présente demande afin de cesser d’occuper constitue un appel déguisé ou une façon de contourner la décision rendue ce jour refusant la demande de remise; [ 9 ] CONSIDÉRANT que les dispositions préliminaires du Code de procédure civile requièrent d’assurer l’accessibilité à la justice, la qualité et la célérité du processus judiciaire; [ 10 ] CONSIDÉRANT que la saine administration de la justice ne permet pas que l’on puisse déjouer les fins de la justice en utilisant un stratagème comme la révocation du mandat pour contourner une décision; [ 11 ] CONSIDÉRANT que la date de l’audition est connue depuis des mois; [ 12 ] CONSIDÉRANT que les ressources judiciaires ont été mises à la disposition des parties pour un procès de trois jours dont la valeur monétaire n’atteint pas 80 000 $; [ 13 ] CONSIDÉRANT que les motifs pour la demande de cesser d’occuper n’apparaissent pas sérieux. [9] We find no fault in the trial judge’s decisions.
The situation in which the appellant found herself was entirely of her own making and that of her new attorneys. There was consequently no breach of procedural fairness in this case. It is noteworthy that the appellant raises no issue with respect to the judgment on the merits of the claim for payment for services rendered.
