RESPONDENT – Plaintiff JUDGMENT [ 1 ] The petitioner seeks permission to appeal the judgment rendered on December 6, 2013 by the Superior Court, District of Montreal (the Honourable Madam Justice Danielle Turcotte), which conclusions read as follows: [41] ACCUEILLE les requêtes du père (#329 et #347); [42] MAINTIENT la suspension des droits d’accès, de même que toute forme de contact de la mère auprès de son fils Y; [43] SUSPEND le paiement de la pension alimentaire payable par le père; [44] AUTORISE le père à voyager à l’extérieur du pays avec son fils Y et à renouveler son passeport, sans qu’il soit nécessaire d’obtenir l’autorisation de la mère; [45] AUTORISE le père à prendre seul toutes les décisions concernant son fils Y, notamment quant à sa santé et à son éducation; [46] CONVOQUE les parties à une conférence de gestion, à une date à être déterminée au début du mois de décembre 2014, afin de faire le point sur l’évolution du dossier et sur la possibilité d’instaurer à nouveau des accès; [47] SANS FRAIS , vu la nature du dossier. [ 2 ] Petitioner pleads that she needs permission to appeal while counsel for the respondent argues that she does not. [ 3 ] The motion to seek leave to appeal is the only motion presented by petitioner.
Therefore, for the time being, the only question to be resolved is whether or not such permission is needed. [ 4 ] Even though the judgment rendered mainly dispose of her motion to vary accessory measures (to restore and modify access to her son), Petitioner, who represents herself, qualifies it as interlocutory since it also grants respondent's motion #347 titled " Father's amended motion of July 2013 to renew an interim order " (see paragraph 41 of the judgment hereinabove reproduced) and it summons the parties to a follow-up session on reinstatement of access rights in December 2014 (see paragraph 46 above) to manage further steps. [ 5 ] Counsel for the respondent pleads that, notwithstanding the language used and impressions at first glance, one has no other choice but to conclude that the judgment rendered is final since it decides, on their merits and after 3 days of proof and hearing, motions to vary accessory measures to a divorce.
The fact that the judge saw fit to stay hands on, in a management role as to any further motion to vary accessory measures, makes no difference as far as qualification is concerned, says counsel. [ 6 ] While understanding easily petitioner's position and difficulties, I nevertheless conclude that the judgment rendered on December 6, 2013 is effectively a final judgment. A party can immediately appeal such a judgment as of right, within the 30-day time limit prescribed by
article 21 of the Divorce Act which reads as follows:
(1) Sous réserve des paragraphes (2) et (3), les jugements ou ordonnances rendus par un tribunal en application de la présente loi, qu’ils soient définitifs ou provisoires, sont susceptibles d’appel devant une cour d’appel.
(2) Il ne peut être fait appel d’un jugement qui accorde le divorce à compter du jour où celui-ci prend effet.
(3) Il ne peut être fait appel d’une ordonnance rendue en vertu de la présente loi plus de trente jours après le jour où elle a été rendue.
(4) Une cour d’appel ou un de ses juges peuvent, pour des motifs particuliers, et même après son expiration, proroger par ordonnance le délai fixé par le paragraphe (3).
(5) La cour d’appel saisie peut :
a) rejeter l’appel;
b) en faisant droit à l’appel : (
i) soit rendre le jugement ou l’ordonnance qui auraient dû être rendus, y compris toute ordonnance, différente ou nouvelle, qu’elle estime juste, (ii) soit ordonner la tenue d’un nouveau procès lorsqu’elle l’estime nécessaire pour réparer un dommage important ou remédier à une erreur judiciaire.
(6) Sauf disposition contraire de la présente loi ou de ses règles ou règlements, l’appel prévu au présent
article est formé et instruit, et il en est décidé, selon la procédure habituelle applicable aux appels interjetés devant la cour d’appel contre les décisions du tribunal qui a rendu l’ordonnance ou le jugement frappés d’appel. 21.
(1) Subject to subsections (2) and (3), an appeal lies to the appellate court from any judgment or order, whether final or interim, rendered or made by a court under this Act.
(2) No appeal lies from a judgment granting a divorce on or after the day on which the divorce takes effect.
(3) No appeal lies from an order made under this Act more than thirty days after the day on which the order was made.
(4) An appellate court or a judge thereof may, on special grounds, either before or after the expiration of the time fixed by subsection (3) for instituting an appeal, by order extend that time.
(5) The appellate court may (
a) dismiss the appeal; or (
b) allow the appeal and (
i) render the judgment or make the order that ought to have been rendered or made, including such order or such further or other order as it deems just, or (ii) order a new hearing where it deems it necessary to do so to correct a substantial wrong or miscarriage of justice.
(6) Except as otherwise provided by this Act or the rules or regulations, an appeal under this
section shall be asserted, heard and decided according to the ordinary procedure governing appeals to the appellate court from the court rendering the judgment or making the order being appealed. [ 7 ] Therefore, the motion to seek leave is without object and should be dismissed as in Droit de la Famille – 13446 ( 2013 QCCA 358 ), a similar situation: [4] Selon moi, le jugement entrepris était appelable de plein droit aux termes de l' article 21(1) de la
Loi sur le divorce et de l'
article 26 , al. 1 (1), C.p.c . D'un côté, le jugement entrepris n'est pas interlocutoire, car postérieur au jugement final de divorce (article 29, al. 3, C.p.c. ). De l'autre côté, il s'agit d'un jugement final qui tranche une demande de modification des mesures accessoires portant sur la pension alimentaire future de l'intimée et qui fixe la quotité passée et future des frais particuliers qui font
partie de la pension alimentaire pour enfants. Un tel jugement est appelable de plein droit selon la jurisprudence de la Cour. Il s'ensuit que la requête du requérant doit être rejetée, car inutile. [Reference omitted.] [ 8 ] Petitioner is not left without a recourse since she may present to the Court or to one of its judges a motion to extend the time limit of 30 days as per article 21 (4) of the Divorce Act (hereinabove mentioned) if she sees fit to do so.
