Avocats à l’audience : Pour l’appelant : Aucune comparution Pour l’intimée : Kathryn Gregory, c.r. THE COURT The appeal is dismissed. LA COUR L’appel est rejeté. The following is the judgment delivered by THE COURT (Orally) [ 1 ] Dylan Robert Douglas Gogan was convicted of assault with a weapon ( s. 267 (
a) of the Criminal Code ) and was sentenced to five months in jail. The incident in question occurred in a federal penitentiary and was captured on video. [ 2 ] Mr. Gogan appeals his conviction on two grounds: (1) an error relating to information the judge was provided regarding others who had been charged with offences arising out of the same incident; and (2) an error of law regarding the defence of self-defence. [ 3 ] The first ground of appeal is vaguely worded. It is unclear to us whether it alleges an error of law, one of fact or one of mixed law and fact. In any event, there is no merit to it.
In his decision, the judge acknowledged the fact three others had pleaded guilty to attacking Mr. Gogan after his initial assault on the victim, but otherwise the judge made no use of this evidence to support a conviction.
[ 4 ] As to the second ground of appeal, the trial judge effectively found there was no air of reality to the defence since there was no evidential foundation reasonably capable of supporting the inferences required for it to succeed. We agree. [ 5 ] Accordingly, Mr. Gogan’s appeal against conviction is dismissed.
