N° : 550-41-000095-040 DATE : 11 mars 2011 ______________________________________________________________________ SOUS LA PRÉSIDENCE DE : L’HONORABLE MICHEL SÉGUIN, J.C.Q. ______________________________________________________________________ Dans la cause de: X Née le […] 1998 ______________________________________________________________________ JUGEMENT ______________________________________________________________________ [ 1 ] La Cour est saisie d'une requête en révision et en prolongation d'une ordonnance rendue le 17 mai 2010, par le juge soussigné qui avait déclaré que la sécurité et le développement de l'enfant, X, étaient toujours compromis et ordonné entre autres mesures qu'elle soit confiée à sa grand-mère paternelle pour une période de neuf mois. [ 2 ] La requête selon l'article 95 de la
Loi sur la protection de la jeunesse allègue que la situation de l'enfant exige une révision et une prolongation de l'ordonnance pour les motifs suivants: - The mother still resides in town A and has no intention to return in the region A; - The collaboration of the Ministry of Children and Family development has been obtained and an evaluation of the mother's situation is underway in town A; - The father has not shown a consistent implication towards his daughter and his situation is unstable; - The paternal grandmother is experiencing some difficulties in offering structure to the child and the situation is fragile. [ 3 ] Toutes les parties sont présentes et consentent aux conclusions recherchées. [ 4 ] La mère a été entendue par la Cour pour indiquer qu'elle était en désaccord avec l'élément contenu au rapport du 24 février 2011 déposé sous la cote D-2 à l'effet que des caméras de surveillance avait été installées dans l'immeuble à logement qu'elle occupe à cause de ses agissements; elle nie donc cette
partie du rapport puisque se serait plutôt elle qui aurait demandé au concierge l'installation de ce type d'équipement à cause du va-et-vient ce qui aurait pu porter à confusion.
Elle se dit, par contre d'accord avec le reste des documents et les conclusions et va faire corriger ce malentendu à son retour en province A. [ 5 ] Considérant les admissions faites par les parties; [ 6 ] Considérant le rapport déposé de consentement; THEREFORE THE COURT : GRANTS the petition; DECLARES that the security and the development of the child is still compromise; REVISES AND EXTENDS the decision rendered on May 17 th , 2010; ORDERS that X be entrusted under her paternal grandmother's care until her majority;
ORDERS that the visits between X and her father be accordingly to the modalities established by the delegate of the Director of Youth Protection; RECOMMENDS that the father demonstrate a stable and sober life style and that he seek professional help if necessary; ORDERS that the visits between X and her mother be accordingly to the modalities established by the delegate of the Director of Youth Protection; RECOMMENDS that X parents undertake to take an active
part in the application of the measures and the intervention plan, designed to put an end to the situation in which the security or development of the child is in compromised; RECOMMENDS that the mother receives services in regards to her personal problems by taking the proper means available in her community such as Support Groups with a recognized program for drugs and alcohol treatment, group treatments for addiction and mental health, anger management treatment or any dependency group that the mother can feel the need to attend; RECOMMENDS that the mother take her medication and follow her doctor's recommendations; RECOMMENDS that the mother avoid any drugs or alcohol; ORDERS that the contacts between X and her maternal grandmother, Ms.
A be accordingly to the modalities established by the delegate of the Director of Youth Protection until judged necessary; RECOMMENDS that X be seen in special counseling for children who has been victim or witness of violence and/or follow up for children of alcoholic parents or any pertinent counseling; RECOMMENDS that X receive appropriate help for her behavior problems at school and at home; ORDERS that a person authorized by the Director of Youth Protection provides aid, counsel and assistance to the child and her family until May 13, 2016 ENTRUSTS the situation of the child to the Director of Youth Protection who shall then see that the measures are carried out. __________________________________ MICHEL SÉGUIN, J.C.Q.
