Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). ______________________________________________________________________ [ 1 ] The present judgment confirms in writing the decision rendered orally at the hearing held on July 18, 2019. [ 2 ] La Directrice de la protection de la jeunesse (la Directrice) demande au Tribunal de prolonger son ordonnance rendue le 19 septembre 2018. [ 3 ] Plus spécifiquement, elle demande de confier X (2 ans) auprès de sa famille d’accueil actuelle et qu’un suivi social soit offert à la famille pour une période de neuf (9) mois.
Le plan de vie envisagé par la Directrice est l’adoption. [ 4 ] L’enfant, par la voix de son avocat, est en accord avec les mesures proposées. [ 5 ] Les parents sont absents lors de l’audience. CONTEXTE [ 6 ] Depuis la dernière ordonnance, la situation des parents demeure au statu quo . [ 7 ] Ils ne collaborent pas au suivi social. Dans les faits, les intervenants ne savent pas où ils se trouvent ni comment les rejoindre [ 8 ] Les parents n’ont eu aucun contact avec leur fille depuis le mois de mars 2018.
[ 9 ] L’enfant se développe, somme toute, bien dans son milieu d’accueil actuel. Bien que l’enfant présente certains défis au plan de l’attachement, ses parents d’accueil sont en mesure d’y voir et demeurent très investis auprès d’elle. Ils veulent s’investir à long terme dans la vie de la petite. [ 10 ] Le plan de vie privilégié pour l’enfant est l’adoption. À la suite d’une évaluation psychologique, les parents d’accueils ont été recommandés à cette fin. [ 11 ] Les parents d’accueil sont très impliqués dans toutes les sphères de la vie de la petite, ils voient à l’ensemble de ses besoins.
L’enfant a fait de beaux progrès notamment au plan de la parole. ANALYSE ET DÉCISION [ 12 ] Les délais maximaux de placement sont atteints. [ 13 ] Les parents sont absents de la vie de l’enfant. [ 14 ] L’enfant se développe positivement et elle a développé un lien significatif avec ses parents d’accueil. [ 15 ] Le Tribunal doit rendre une ordonnance prévoyant la stabilité et la continuité des soins pour l’enfant. [ 16 ] Les parents sont absents lors de l’audience, ils n’ont pas vu l’enfant depuis plusieurs mois.
Un retour auprès d’eux est irréaliste et serait contraire à l’intérêt de l’enfant. [ 17 ] Le but de la mesure est d’élaborer un plan de vie permanent pour l’enfant. [ 18 ] Le Tribunal estime que les mesures proposées sont dans le meilleur intérêt et le respect des droits de l’enfant. CONSEQUENTLY, AND FOR THESE REASONS, THE COURT: [ 19 ] GRANTS the Application [ 20 ] DECLARES that the security and the development of the child continue to be endangered within the meaning of the Youth Protection Act ; AND IN VIRTUE OF THE POWERS CONFERRED UPON THE COURT BY
SECTION 91 OF THE YOUTH PROTECTION ACT: [ 21 ] ENTRUSTS the child in the confidential foster home of Mrs. C and Mr.
D; [ 22 ] SUSPENDS all contacts between the child and her parents until they meet three (3) consecutive time the delegate to demonstrate their ability to engage in services; [ 23 ] Thereafter , ORDERS that the frequency and modality of contacts between the parents and the child be determined by the Director of Youth Protection, taking into consideration the best interest and the needs of the child; [ 24 ] WITHDRAWS to the parents the exercise of parental authority with regards to medical, educational, social and travel needs, including applying for a passport and ORDERS that Mrs. C and Mr.
D be granted of the exercise of those parental authority; [ 25 ] AUTHORIZES the Director of Youth Protection to share and obtain information with professionals involved with the child and her family; [ 26 ] ORDERS that aid, counsel and assistance be provided to the child and the family; [ 27 ] ENTRUSTS the situation of the child, X, to the Director of Youth Protection of the Centre intégré universitaire de santé et services sociaux (CIUSSS) A, who shall then see that the measures are carried out; [ 28 ] ORDERS the execution of the present judgment by any peace officer if necessary; [ 29 ] THE WHOLE for a period of nine (9) months.
