Section 95 Youth Protection Act , R.S.Q. c. P-34.1 ) ______________________________________________________________________ WARNING: The Youth Protection Act forbids the publishing or broadcasting of information allowing for a child or the child’s parents to be identified.
Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] The Director of Youth Protection (the “Director”) asks the Court to review the decisions made on October 2 nd 2018 in the situation of the child, X. [ 2 ] The parents are present in Court and admit part of the alleged facts. They accept the proposed measures. [ 3 ] The child is 7 years old. He was present in the Court house and saw his lawyer. He was not present in the courtroom.
His lawyer represents that he feels safe at home and wants to stay with his parents. [ 4 ] The parents have their ups and downs. They consume drugs and alcohol and have some violent conjugal relations at some moments. [ 5 ] The situation has calmed down since October 2019. [ 6 ] The parents accept the help of the Director and the mother goes to social services regularly. [ 7 ] The family still needs help in order to ensure a safe environment for the child.
FOR ALL THESE REASONS, THE COURT: [ 8 ] GRANTS the application; [ 9 ] DECLARES that the security and development of the child, X, are still in danger; [ 10 ] REVISES the decision rendered on October 2 nd 2018; [ 11 ] ORDERS that the child be entrusted to the parents;
[ 12 ] ORDERS that the parents report in person, at regular intervals, to the Director of Youth Protection to inform him of the current situation; [ 13 ] ORDERS that the parents remain sober and without violent behaviours in the presence of the child; [ 14 ] ORDERS that the parents seek help through social services for their alcohol, drugs and personal issues; [ 15 ] ORDERS that a person working for an institution or body provide aid, counsel and assistance to the child and the family; [ 16 ] ENTRUSTS the situation of the child, X, to the Director of Youth Protection for the execution of the measures; [ 17 ] THE WHOLE until September 30 th 2020. __________________________________ JEAN GRAVEL, J.Q.C.
