s) Adam Scott Clerk BY THE JUDGE REASONS FOR THE JUDGMENT RENDERED AT THE HEARING ON JUNE 2, 2017 [ 6 ] Institutional confinement is one instance in which the law allows a deprivation of liberty by judicial order. In every instance the exercise of such power is subject to conditions to ensure that a deprivation of liberty is authorised only to the extent necessary. The policy of the law is to privilege liberty and thus to ensure that institutional confinement is exceptional. I [ 7 ] Mr. I.
F. seeks the suspension of an order for institutional confinement for fifteen days that was made by the Court of Quebec on 26 May 2017. I granted his motion on 2 June 2017. [ 8 ] The order made on 26 May 2017 was the third concerning Mr. F. and thus a second renewal of an order for thirty days that was first made in February 2017. Mr. F. claims that the third order does not satisfy the requirements of the law. II [ 9 ] There is no doubt that Mr. F. has a variety of problems, some of them medical, and that he needs help in dealing with them.
The two psychiatric reports filed as Exhibit P-1 recommend institutional confinement for thirty days but the cursory observations in those reports fail to justify in what manner Mr. F. presents a danger that meets the criteria established by
article 30 C.C.Q. and the relevant jurisprudence. [1] I do not question that Mr. F. would benefit from psychiatric treatment but that, without more, is not the test for an order of institutional confinement. [ 10 ] Apart from the two reports, the evidence presented at the hearing makes plain that Mr. F. needs professional assistance of various kinds. But institutional confinement is not a measure for social welfare. It is an exceptional measure to respond to a crisis in which there is compelling evidence that a person represents a clear danger to himself or to others. Nothing less can justify a deprivation of liberty. PATRICK HEALY , J.A.
