Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] The adolescent undertook a gender transition process.
Their foster family was not supportive, to the contrary. [ 2 ] For the last few months, the adolescent has lived with a cousin, now acting as a kinship foster family, on a provisional basis. [ 3 ] The director of youth protection (DYP) now asks that the adolescent remain entrusted to their new foster family for the few months yet to come until their majority. [ 4 ] The adolescent enjoys living in their foster family and wishes to remain there. [ 5 ] The evidence convinces the Court that the application is well founded as the recommended measures meet the adolescent’s best interest.
FOR THESE REASONS AND THOSE EXPRESSED ORALLY AT THE HEARING, THE COURT: [ 6 ] GRANTS the application for revision of order; [ 7 ] DECLARES that the security and development of X are still considered to be in danger according to
section 38 of the youth protection act ; [ 8 ] ORDERS that the adolescent be entrusted to a foster family designated by the director of youth protection until March 13, 2022; [ 9 ] ORDERS that the parents report periodically to the director of youth protection on the measures they apply in their own regard or in their child’s regard to put an end to the situation in which the security or development of the adolescent is in danger; [ 10 ] ORDERS that the contact between the adolescent and the father be determined according to an agreement between the parties; [ 11 ] RECOMMENDS that the adolescent continue to receive follow-up in a psychological assessment and counselling;
[ 12 ] ORDERS that the adolescent and the parents actively participate in the application of the measures ordered; [ 13 ] ORDERS that a person working for an organization or institution bring to the adolescent as well as to the family, help, advice and support until March 13, 2022; [ 14 ] ENTRUSTS the situation of the adolescent to the director of youth protection of the Centre intégré de santé et de services sociaux A for the carrying out of the judgment; [ 15 ] ORDERS that the parties concerned by this order comply with it. __________________________________________ JANICK POIRIER, J.C.Q.
