The following is the judgment delivered by THE COURT [ 1 ] On June 6, 2012, a judge of the Provincial Court convicted Bennett E. a) of the Criminal Code ); (2) resisting peace officers in the execution of their duty ( s. 129 ( a )); and (3) assault with a weapon ( s. 267 ( a )). The judge sentenced him to a fine of $1,200 plus a 15% victim fine surcharge for the impaired driving charge, as well as a 12-month driving prohibition. With respect to resisting arrest and assault with a weapon, the judge imposed a $300 fine and a $45 victim fine surcharge for each offence in addition to 1 year of supervised probation with respect to the assault. His application for leave to appeal from conviction based upon issues that involve a question of fact or mixed law and fact is dismissed. Similarly, his application to appeal against the sentence passed is dismissed. [ 4 ] The appeal and the applications for leave to appeal are dismissed. ____________________________________ M.E.L.
