Any person who contravenes this provision commits an offence and is liable to a fine. (Sections 11.2, 11.2.1 and 135 Y.P.A .) APERÇU [ 1 ] Le 8 juillet 2019, la mère demande le placement de l’adolescente puisqu’elle se dit épuisée par les difficultés comportementales que présente de cette dernière. [ 2 ] Le 15 juillet 2019, l’adolescente est confiée provisoirement à sa grand-mère maternelle, madame C.
Elle y demeure depuis. [ 3 ] Puisque la famille nécessite toujours des services, la Directrice de la protection de la jeunesse demande au Tribunal de réviser l’ordonnance rendue le 12 juin 2019 et de maintenir l’adolescente auprès de sa grand-mère maternelle avec un suivi social pour une période de quatre mois. [ 4 ] La mère est absente lors de l’audience, mais transmet à l’intervenante sociale son accord quant aux mesures recommandées. [ 5 ] Le père n’est pas présent dans la vie de l’adolescente et ne collabore pas au suivi social.
Considérant l’intérêt de l’adolescente, le Tribunal a procédé en son absence. [ 6 ] L’adolescente se dit en accord avec les mesures proposées par la Directrice. ANALYSE [ 7 ] Bien qu’elle demeure par moment fragile sur le plan émotionnel, l’adolescente évolue tout de même de manière positive auprès de sa grand-mère maternelle. Cette fragilité peut se traduire par des comportements anxieux, autodestructeurs ou impulsifs envers son entourage. [ 8 ] Le 24 novembre 2019, la grand-mère interpelle son éducateur puisque l’adolescente se montre agressive dans ses propos à son endroit ainsi qu’à l’endroit de sa mère.
Elle est aussi peu transparente concernant ses fréquentations, ce qui inquiète grandement la famille. Des répits sont disponibles et utilisés en moment de crise. [ 9 ] L’adolescente est consciente de ses difficultés. Elle veut s’améliorer et fait des efforts afin de respecter le cadre mis en place par sa grand-mère maternelle.
[ 10 ] L’adolescente participe à son suivi psychiatrique et prend sa médication, ce qui apaise grandement son anxiété, sa tristesse et sa colère. Elle est au courant qu’une aide thérapeutique peut lui être offerte si elle le désire et le Tribunal l’encourage fortement à y recourir pour apaiser ses souffrances. Notons qu’elle participe activement à son suivi éducatif auprès du programme A. [ 11 ] Les enjeux sur le plan de la fréquentation scolaire demeurent d’actualité. L’adolescente s’absente régulièrement de l’école ou arrive en retard. Pendant ces périodes, ses fréquentations demeurent inconnues.
De plus, elle présente des comportements opposants en classe, notamment en refusant de participer aux travaux. [ 12 ] La relation entre l’adolescente et sa mère s’est améliorée. Les contacts entre elles sont fréquents et s’avèrent positifs. La mère demeure très présente pour sa fille. [ 13 ] Le Tribunal souligne l’investissement de la grand-mère maternelle. L’adolescente est en processus de transition pour changer de genre et vit beaucoup d’émotions, ce qui a des impacts notables sur ses relations familiales.
Malgré ceci, la grand-mère poursuit son engagement et son implication dans les différents services offerts à la famille. [ 14 ] Après avoir reçu les admissions, apprécié l’ensemble de la preuve et l’intérêt de l’adolescente, le Tribunal conclut que la sécurité et le développement de cette dernière demeurent compromis au sens de la
Loi sur la protection de la jeunesse . Comme mentionné précédemment, les mesures proposées par la Directrice répondent au meilleur intérêt de l’adolescente et le Tribunal entend y faire droit. THEREFORE, THE COURT: [ 15 ] GRANTS the Application; [ 16 ] REVISES the decision rendered on June 12, 2019; [ 17 ] DECLARES that the security and the development of the adolescent, X , are still compromised under the Youth Protection Act ; AND ORDERS THE FOLLOWING MEASURES: [ 18 ] ENTRUSTS the adolescent to the care of her maternal grandmother, Mrs.
C; [ 19 ] TAKES JUDICIAL NOTICE that the maternal grandmother will be assessed as a kinship foster home and if approved, ORDER that the adolescent be entrusted to the foster home of her maternal grandmother, Mrs.
C; [ 20 ] ORDERS that the coordinate of the maternal grandmother remain confidential; [ 21 ] TAKES ACT that respite can be provided to the adolescent if needed; [ 22 ] TAKES NOTICE that the adolescent is in agreement, if needed, to benefit from respite; [ 23 ] ORDERS that the frequency and modalities of contact between the adolescent and her mother be determined upon agreement between the party; [ 24 ] ORDERS the father, Mr.
B, not to contact directly or indirectly the adolescent, including on social media; [ 25 ] ORDERS the adolescent to respect her grandmother’s rules and inform her about her whereabouts; [ 26 ] ORDERS the mother to refrain from using inappropriate methods of discipline; [ 27 ] ORDERS the adolescent to continue to participate to her psychiatric follow-up, notably by taking her medication as prescribed; [ 28 ] RECOMMENDS that the adolescent participate in therapeutic support services to help her coping with her emotions and her mental health issues; [ 29 ] RECOMMENDS that the mother continue to meet with the professionals involved with the adolescent; [ 30 ] ORDERS the adolescent to attend school on a daily basis, unless a valid medical reason is provided; [ 31 ] RECOMMENDS that the adolescent, the mother and the maternal grandmother continue to actively participate and engage with the Program A; [ 32 ] TAKES NOTICE that the services of the Program B will be provided to the adolescent; [ 33 ] ORDERS that a person working for a Child and Youth Protection Center provide aid, counsel and assistance to the adolescent and her family, including the services of an educator as long as deemed necessary; [ 34 ] THE WHOLE for a period of 4 months; [ 35 ] ENTRUSTS the situation of the adolescent, X , to the Director of Youth Protection of the Centre intégré universitaire de santé et de services sociaux A, who shall see that the measures are carried out.
