a) du Code criminel du Canada; • 3 ans pour avoir eu en sa possession une arme, à savoir une pointe de laiton de cinq pouces, dans un dessein dangereux pour la paix publique, en violation de l’ al. 88(2) du Code criminel du Canada;
English version of the decision delivered by THE COURT I.
Introduction and background [1] Jonathan Haché is serving a life sentence, having been convicted of second-degree murder in2005. On July 13, 2015, two correctional officers escorted him to the hospital in Miramichi for treatment of an injury he inflicted uponhimself while in prison. Once at the hospital, while the correctional officers were trying to get him out of the vehicle in which he wastransported, Mr. Haché, despite being restrained, managed to stab Denis Poirier, one of the correctional officers, with a shank he had inhis possession. An altercation ensued between Mr.
Haché, at least two correctional officers and a hospital security guard. [2] Mr. Haché pled guilty to the criminal charges brought against him and a Provincial Courtjudge imposed the following sentences, to be served concurrently:
• 8 years for injuring Denis Poirier, the correctional officer, thereby committing an aggravated assault contrary to s. 270.02 of theCriminal Code of Canada; • 6 years for assaulting Denis Poirier, a correctional officer from the Atlantic Institution who was engaged in the execution of hisduty, contrary to s. 270(1)(
a) of the Criminal Code of Canada; • 5 years for assaulting Howard Butler, contrary to s. 266(
a) of the Criminal Code of Canada; • 3 years for possession of a weapon, being a five-inch brass pick, for a purpose dangerous to the public peace, contrary to s. 88(2)of the Criminal Code of Canada; • 3 years for attempting to escape from lawful custody, contrary to s. 145(1) and s. 463(
b) of the Criminal Code of Canada. [3] The Crown seeks leave to appeal and, if leave is granted, it asks that the sentence be varied so that thesentence imposed for aggravated assault against the correctional officer be served consecutively to the other sentences, as required bys. 270.03 of the Criminal Code of Canada, but concurrently to the life sentence. [4] The Court offered Mr. Haché the possibility of appearing by videoconference; however, he did not want to bepresent. Upon examining the record, it became clear that other errors had occurred at the time of sentencing.
These were brought to theattention of the Crown, who acknowledged them. Therefore, the sentences imposed are varied accordingly. II. Disposition [5] Leave to appeal is granted and the appeal is allowed. With the consent of the Crown, uponapplication of the principle in Kienapple v. R., (CSC), [1975] 1 S.C.R. 729, [1974] S.C.J. No. 76 (QL), a stay ofproceedings is ordered for the offence under s. 270(1)(
a) and we substitute the following sentence for the sentence imposed: • a three-year term of imprisonment for the offence under s. 266(a); a three-year term of imprisonment for the offence under s. 88(2)(a); and a one-year term of imprisonment for the offence under s. 145(1)(a). These three sentences are to be served concurrently to eachother and concurrently to the life sentence; • an eight-year term of imprisonment for the offence under s. 270.02. This sentence will be served consecutively to the threeprevious sentences, but concurrently to the life sentence.
