Plaintiff v. 9189-5805 QUÉBEC INC., doing business under the trade name of ROYAL MX VICTOIRE and VICTOR FARRI Defendants ______________________________________________________________________ JUDGMENT ______________________________________________________________________ [ 1 ] Plaintiff, EGP Technovirtuel inc., operates a website providing advertisement services for a posted listing of an immoveable available for sale to real estate brokers. [ 2 ] On July 16, 2008, Plaintiff entered into a service contract with real estate broker Victor Farri and his company Royal MX Victoire (P-1). [ 3 ] Plaintiff claims $3, 641.78 for services rendered as per contract (P-1) for the period of November 15, 2009 until August 15, 2011. [ 4 ] Defendants are not present at trial to contest. [ 5 ] Plaintiff’s representative, Mr.

Gilles Paquette, affirms that Plaintiff never received the letter dated May 1, 2010, which Defendants, in their written contestation, purported to be a notice of resiliation of the contract. [ 6 ] The Court concludes that the testimony of Mr. Paquette and the documentary evidence submitted at trial support the claim.

FOR THESE REASONS, THE COURT: [ 7 ] GRANTS Plaintiff’s action; [ 8 ] CONDEMNS Defendants 9189-5805 Québec inc., doing business under the trade name of ROYAL MX VICTOIRE, and Victor Farri, solidarily, to pay Plaintiff, EGP Technovirtuel inc., the sum of $3,641.78, plus interest at the legal rate of 5 % per annum and the additional indemnity provided for at

Article 1619 of the Civil Code of Québec , as of August 25, 2011; [ 9 ] CONDEMNS Defendants 9189-5805 Québec inc., doing business under the trade name of ROYAL MX VICTOIRE, and Victor Farri, solidarily, to pay Plaintiff, EGP Technovirtuel inc., judicial costs of $135 for the legal stamp and $64.84 for the bailiff. ________________________________ MARTINE L.
