[ 1 ] On April 22, 2015, after having read the proceedings; [ 2 ] CONSIDERING the Motion and Affidavit produced; [ 3 ] CONSIDERING that the Plaintiff is not contesting the Defendant’s « Motion requesting to be released from a seizure by providing a sufficient guarantee »;. [ 4 ] FOR THESE REASONS, THE COURT : GRANTS the present Motion; PRAYS ACTE of the Defendant’s offer to furnish security for the total sum of $24,000.00; ORDERS an immediate partial release of the seizure before judgment made in the present instance and that the garnishee Bank of Montreal immediately transfer upon receipt of the present judgment the sum of $24,000.00 seized in the Defendant’s bank account to the trust account of Municonseil Avocats Inc; ORDERS immediately upon written confirmation by the Defendant’s attorneys that the said sum of $24,000.00 has been deposited into their trust account that the seizure before judgment made in the present instance is released; PRAYS ACTE of the undertaking of Municonseil Avocats inc. to retain in trust the said sum of $24,000.00 to be received from the Third Party Garnishee Bank of Montreal and to dispose of the said sum only pursuant to the terms of a final judgment to be rendered in the present proceedings or otherwise pursuant to a written agreement concluded between the parties; THE WHOLE without costs. _____________________________ HENRI RICHARD, J.C.Q.
