Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d’identifier un enfant ou ses parents. Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.). [ 1 ] Le 1 er avril dernier pour les motifs exposés dans son jugement, le Tribunal déclarait compromis la sécurité et le développement des enfants X et Y, victimes de négligence importante sur le plan physique et au niveau éducatif au sens de l'article 38 b) 1)
i) et iii) de la
Loi sur la protection de la jeunesse. [ 2 ] Cette situation est récurrente même si la mère a reçu de nombreux services au fil des ans. Le Tribunal a choisi de reporter l'audition sur les mesures applicables au 26 août afin de vérifier notamment la capacité de la mère à se responsabiliser. [ 3 ] Ce jour, la Directrice de la protection de la jeunesse demande de maintenir les enfants auprès de leur mère. Elle désire poursuivre l'ensemble des services dispensés auprès de cette famille notamment ceux d'assistance éducative et ce, pour la prochaine année.
Elle dépose un rapport complémentaire faisant état de la situation depuis le mois d'avril dernier. [ 4 ] La mère acquiesce aux mesures recherchées. L'avocate des enfants y souscrit également. Elle précise cependant que la Directrice doit être des plus vigilantes. [ 5 ] Madame [intervenante 1], intervenante sociale, témoigne qu'elle observe des progrès. Elle peut compter, dit-elle, sur la collaboration de la mère. [ 6 ] L'état des lieux est plus propre et à l'exception de la cuisine, moins encombrés. Les lieux sont donc plus sécuritaires.
La mère s'est départie du gros chien et des chats, ne conservant que le petit chien. La mère a également résolu le problème de moisissure de son logement. [ 7 ] À l'exception de quelques jours, les enfants ont fréquenté l'école régulièrement. La mère a renoué avec sa mère. Elles ont réglé
leurs différends. La mère reçoit beaucoup de support du milieu familial élargi. Elle réalise désormais l'importance de pouvoir compter sur eux. [ 8 ] La mère attend un troisième enfant. Elle n'a jamais pu par le passé compter sur la collaboration du père des enfants, aujourd'hui décédé. Elle anticipe toutefois pouvoir miser sur la collaboration du père de son enfant à naître et ce, même si elle a choisi présentement de résider seule avec ses deux enfants. [ 9 ] La mère énonce apprécier le support de monsieur C, éducateur.
La mère qui démontrait une ambivalence quant à son lieu de résidence a finalement choisi de résider dans la région A, ce qui permettra aux enfants de demeurer à la même école. [ 10 ] La mère se faisant s'est rapprochée du domicile de ses parents. L'an prochain, les grands-parents et la mère caressent le projet de se porter acquéreur d'un duplex afin d'être tous ensemble. [ 11 ] La preuve non contredite démontre que la mère s'est mise en action.
La Directrice de la protection de la jeunesse devra toutefois demeurer vigilante puisque les difficultés de la mère découlent de son incapacité à persévérer au fil du temps, d'où la récurrence des problèmes constatés quant à la négligence des enfants. [ 12 ] POUR CES MOTIFS, LE TRIBUNAL: [ 13 ] GRANTS the motion; [ 14 ] DECLARES that the security and the development of the children X and Y are in danger for the following reasons: ― 38 b) 1) i) : neglect of basic physical needs; ― 38 b) 1) iii) : neglect on educational level; [ 15 ] ORDERS that the children X and Y remain with their mother and that the mother report periodically to the Director of Youth Protection on the measures she applies to put an end at the situation in which the security or development of the children is in danger; [ 16 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to the children X and Y and their family for a period of one (1) year; [ 17 ] ORDERS that the mother of the children X and Y take an active

Every person who contravenes this provision is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [1] On April 1, 2015, for the reasons given in its judgment, the Court declared the security and development of the children X and Y in danger, as they were victims of serious neglect from a physical and educational standpoint within the meaning of
section 38( b )(1)(
i) and (iii) of the Youth Protection Act . [2] That situation is recurrent, although the mother has received numerous services over the years. The Court chose to postpone the hearing on the applicable measures to August 26, to verify, in particular, the mother’s ability to act responsibly. [3] On that day, the Director of Youth Protection asked that the children be kept with their mother. The Director wanted to continue all of the services provided to the family, in particular educational assistance, over the coming year.
She filed an additional report describing the situation since April 2015. [4] The mother agreed to the measures sought. The children’s attorney was also in agreement. However, she specified that the Director must be highly vigilant. [5] [intervenante 1], social worker, testified that she had seen progress. She said that she can count on the mother’s cooperation. [6] The home is cleaner and, with the exception of the kitchen, less cluttered. Thus, the premises are safer. The mother got rid of the big dog and the cats, and kept only the little dog.
The mother also resolved the problem with mould in her home. [7] The children attended school regularly, except for a few days. The mother renewed contact with her mother. They resolved their disagreements. The mother receives much support from the extended family environment. She now realizes the importance of being able to count on her extended family. [8] The mother is expecting a third child. In the past, she was never able to rely on the cooperation of the children’s father, now deceased.
However, she expects to be able to rely on the cooperation of her unborn child’s father, even though at the moment she has chosen to live alone with her two children. [9] The mother said that she appreciated the support of Mr. C, the educator. The mother, who was ambivalent about her place of residence, ultimately chose to live in the Brome A, which will enable the children to remain at the same school. [10] The mother’s move brought her closer to her parents’ home.
The grandparents and the mother entertain a plan to acquire a duplex so they can all be together next year. [11] The uncontradicted evidence demonstrates that the mother has taken action. However, the Director of Youth Protection must remain vigilant, as the mother’s problems stem from her inability to persevere over time, thus the recurrent problems noted regarding neglect of the children. [12] THEREFORE, THE COURT: [The following passage appears in English in the original French-language judgment.] [13] GRANTS the motion;
