Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). ______________________________________________________________________ [ 1 ] The present judgment confirms in writing the decision rendered orally at the hearing held on February 17, 2016. [ 2 ] La Directrice demande au Tribunal de prolonger l’ordonnance rendue le 28 janvier 2015 par madame la juge Lefebvre.
Elle indique que la sécurité et le développement des enfants, Y et X sont toujours compromis pour les mêmes motifs de compromission soit l’exposition à un conflit de séparation. [ 3 ] Elle demande à
titre de mesure principale qu’un suivi social soit offert à la famille afin de consolider certains acquis, le tout pour une période de neuf mois. [ 4 ] Les parents sont en accord avec les mesures proposées. [ 5 ] Les enfants par le biais de leur avocate indiquent être en accord avec les mesures proposées.
Context Analysis of the Evidence and Decision [ 6 ] Depuis la dernière ordonnance, la preuve révèle que les parents ont fait de réels progrès. [ 7 ] Avec l’aide d’un éducateur, la mère a structuré la routine de vie des enfants et est maintenant en mesure de leur offrir une plus grande stabilité. [ 8 ] Le père et la mère ont amélioré leur communication, cependant les progrès sont récents et la situation demeure fragile. [ 9 ] Les enfants indiquent être épuisées du rythme de la garde et demandent d’allonger le temps chez chacun des parents. [ 10 ] Le père doit apprendre à faire confiance aux capacités parentales de la mère et cette dernière doit cesser d’être constamment sur la défensive. [ 11 ] Les filles ont besoin que leurs parents soient au diapason notamment quant aux règles à la maison ainsi qu’en regard des soins
de santé plus spécifiquement en lien avec leur asthme. [ 12 ] Les défis demeurent grands malgré une belle amélioration.
Les parents éprouvent encore de la difficulté à communiquer et certains conflits demeurent présents notamment en lien avec l’horaire et l’habillement des filles. [ 13 ] Il est envisagé que les rencontres avec la Directrice se fassent avec les deux parents afin de les aider à développer la qualité de leur communication et leur coparentalité. [ 14 ] Afin de consolider les acquis et favoriser l’épanouissement de la relation parentale, l’aide de la Directrice s’impose. [ 15 ] IN THE CIRCUMSTANCES, THE COURT: [ 16 ] GRANTS the motions; [ 17 ] EXTENDS the decision rendered on January 28, 2015 par the Honorable Michèle Lefebvre; [ 18 ] DECLARES that the security and development of the children are still endangered; [ 19 ] ORDERS that the children remain entrusted to the care of both parents; [ 20 ] TAKES JUDICIAL NOTICE that the parents are in agreement for alternating care biweekly with the objective of finding a stable parenting plan, and once this established, the parents will seek this arrangement in Superior court.
In the event that the parties cannot agree on the custody plan, ORDERS that the frequency and modality of contact between the adolescent and his parents be determined by the DYP, including supervision if deemed necessary; [ 21 ] ORDERS that the parents follow the recommendations of the treating professionals involved with the children, as specified, and that they promptly exchange all medical information; [ 22 ] ORDERS that a person working for a Child and Youth Protection Centre provide aid, counsel and assistance to the children and their family; [ 23 ] ENTRUSTS the situation of the children, Y and X, to the Director of Youth Protection of A Youth and Family Centres, who shall then see that the measures are carried out; [ 24 ] THE WHOLE for a period of nine months.
