[ 2 ] Plaintiffs failed to present evidence in support of their application. [ 3 ] Furthermore, there is no lien de droit between plaintiffs and Salem Layadi personally. [ 4 ] As regards the cross-application, defendant party failed to meet its burden of proof ( articles 2803 and 2804 of the Civil Code of Quebec ). [ 5 ] Indeed, defendant party failed to produce any tangible evidence (including, but not limited to, contracts, invoices, pictures, etc.) in support of its claim. [ 6 ] Furthermore, punitive damages are not warranted in this matter.
WHEREFORE THE COURT HEREBY: DISMISSES the application, with legal costs; and DISMISSES the cross-application.
