Partie défenderesse ______________________________________________________________________ JUGEMENT ______________________________________________________________________ [ 1 ] VU l'absence de la
partie défenderesse Lise Anne Bell, laquelle n'a pas contesté la demande qui lui fut dûment signifiée (huissier) le 16 mars 2011;
[ 2 ] VU la preuve testimoniale et documentaire (P-1 à P-5) offerte par la
partie demanderesse 4235011 Canada Inc., représentée à l'audience par monsieur Peter Michalakopoulos; [ 3 ] CONSIDÉRANT que la
partie demanderesse 4235011 Canada Inc. réclame la somme de 3 200 $ pour les motifs ainsi énoncés à sa demande datée du 14 janvier 2011 : "Defendant requested on a few occasions from a Mr. John Viron, to lend her money to buy certain things, like a lap top computer and other items. Mr. Viron accomodated the Defendant and lent her on three occasions the following amounts.
On March 9, 2007 the amount of $900.00, on November 2, 2007 $1,000.00 and on September 3, 2008 $800.00 as it appears from a copy of the cheques and the hand written acknowledgment by Defendant and signed by her, the whole as it appears from said document and cheques, filed herewith as Exhibit P-1. The agreement between the Defendant and Mr. Viron was that the Defendant would pay Mr. Viron later when she would sell her share of her house and then she would pay Mr. Viron. Defendant sold her house about one and a half or two years ago as Mr. Viron learned. Accordingly, Mr.
Viron began to request from the Defendant to pay him back said loan of $2,700.00. Defendant always promised to pay but always stated that she would pay later, for different reasons.
She would promise to pay on a certain date or week and then she would call to say that she could not make it, that she would call back that she would pay cash, that she would give cheques, that she did not have wallet, that she was waiting for new cheques from the bank, that she had taken the cheques at her work, that she had left the cheques at home, that she had to go to her daughter, that she had to go to the gym, that she had to go out for dinner, that she would come home late, etc., etc., she would give every excuse under the sun, to postpone the payment which she always promised to pay, the whole as it will be proved durng the hearing.
On January 15, 2010 Mr. Viron sent the Defendant a demand letter a copy of which is filed with this application, as Exhibit P-2. As a reply to the said demand letter the Defendant again promised to pay. Defendant made a proposal on March 26, 2010 to pay Mr. Viron a reduced amount. Because Mr. Viron is retired and over seventy years old, he was willing to accept a lesser amount to avoid taking proceedings in Court, spending more money in Courts and having to wait to go to Court and wait several months before he would get a judgment and collect. Despite this accomodation by Mr.
Viron to accept a reduced amount, the Defendant never respected her proposal and continued to make false promises and excuses as stated above.
On March 26, 2010, the Defendant, signed another acknowledgment of debt, where she promised that she would pay in part, the amount she owed, by giving on Monday night the 29 th of March 2010 four (4) cheques post-dated for April, May, June and July 2010 in filed herewith as Plaintiff's Exhibit P-3, a promise she never kept;" [ 4 ] CONSIDÉRANT que la preuve prépondérante permet au Tribunal de retenir que la défenderesse Lise Anne Bell n'a pas remboursé les trois prêts consentis au cours des mois de mars et novembre 2007, et septembre 2008, totalisant la somme de 2 700 $; [ 5 ] CONSIDÉRANT que la
partie demanderesse a prouvé être détentrice de la créance du prêteur John Viron (P-4); [ 6 ] CONSIDÉRANT qu'il y a lieu d'ajouter au remboursement des prêts totalisant la somme de 2 700 $ la somme de 500 $ pour tous les inconvénients, pertes de temps et dommages subis et résultant du non paiement de la défenderesse; POUR CES MOTIFS, LE TRIBUNAL : [ 7 ] ACCUEILLE la demande, [ 8 ] CONDAMNE la
partie défenderesse Lise Anne Bell à payer à la
partie demanderesse 4235011 Canada Inc. la somme de 3 200 $ avec intérêts au taux légal et l'indemnité additionnelle prévue à l'
article 1619 du Code Civil du Québec à compter du 4 juin 2010, avec les frais judiciaires de 176 $. __________________________________ MICHELINE LALIBERTÉ, J.C.Q.
