Any person who contravenes this provision commits an offence and is liable to a fine (sections 11.2, 11.2.1 and 135 Y.P.A.). [ 1 ] The Court is seized with a motion for revision of the judgment rendered on August 17, 2017, by Honourable Renée Lemoine concerning the situation of X, 6 ½ years old. The applicant asks that the child remains in foster family for another year. [ 2 ] At the hearing, the mother is present and assisted by Mtre. Michel Grenier. Mtre. Yan Massé represents the child and Mtre.

Adelia Ferreira the applicant. [ 3 ] The evidence of the facts alleged in support for this revision is constituted of the admissions done by the mother, the testimony of the social worker, Mrs. [Social Worker 2], and the revision report filed. [ 4 ] It is proved that the situation of the mother remains the same. She consumes abusively alcohol and lives with people which consume alcohol and drugs. She had issues at her home, having been recently beat up by her brother and his girlfriend.

The mother is not in position to resume care of the child. [ 5 ] The child remains in the same foster family, but the foster parent does not have her own house. She lives with X at her sister’s place and she has to take care of her sister’s family. [ 6 ] Because of her home situation, the foster mother cannot commit to a long term placement. She needs to move in her own dwelling. [ 7 ] The social worker helps her and supports this plan. She takes good care of the child and both have develop bonds. [ 8 ] The child has some behavioural issues over the past year.

As she has trouble concentrating, she will be assessed by Dr. Julie Marchand, child psychiatrist, in September. A referral was also made to assess whether the child has ADHD. [ 9 ] With this evidence, the Court considers that the recommendations are adequate and insure the stability and security of this vulnerable child.

FOR THESE MOTIVES, THE COURT: [ 10 ] GRANTS the motion; [ 11 ] DECLARES that the security and development of X are still in danger; [ 12 ] ORDERS her placement in a foster family for a period of one year; [ 13 ] ORDERS the Director of Youth Protection to supervise the contacts between the child and her mother as for frequency and modalities;

[ 14 ] ORDERS the mother to seek help for her personal issues; [ 15 ] ORDERS the Director of Youth Protection to provide the child all the medical and psychological assessments and services she requires; [ 16 ] ORDERS the mother to report in person, at regular intervals, to the Director of Youth Protection to inform him of the current situation regarding parental skills, therapy and all other appropriate services concerning her addiction issues; [ 17 ] ORDERS the Director of Youth Protection to provide aid, counsel and assistance to the child and her mother for a period of one year; [ 18 ] ORDERS the police to the execution of the enactment; [ 19 ] ENTRUSTS the child’s situation to the Director of Youth Protection for the purpose of executing this judgment. __________________________________ DENYSE LEDUC, J.C.Q.
