Article 38 de la Loi sur la protection de la jeunesse (L.R.Q. c. P-34.1) et ordonnance de mesures intérimaires ______________________________________________________________________ Mise en garde : La
Loi sur la protection de la jeunesse interdit la publication ou la diffusion de toute information permettant d’identifier un enfant ou ses parents. Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.). [ 1 ] Le Tribunal confirme et motive, par le présent jugement, la décision rendue séance tenante lors de l'audience du 18 mars 2015, conformément aux exigences de l’
article 90 de la
Loi sur la protection de la jeunesse . [ 2 ] La soussignée a remanié les motifs exprimés verbalement, pour en améliorer la présentation et la compréhension. [ 3 ] Le Tribunal doit déterminer si la sécurité et le développement de X sont compromis et le cas échéant, pour quels motifs. [ 4 ] La Directrice de la protection de la jeunesse soutient que la sécurité et le développement de l’adolescent sont compromis en application des articles 38
f) et b) 1 o iii de la
Loi sur la protection de la jeunesse , soit en raison des sérieux troubles de comportement de l’adolescent et de la négligence de sa mère sur le plan éducatif. [ 5 ] La mère admet l’ensemble des allégations du paragraphe 3.6 de la requête : “3.6 the adolescent has serious behavioural disturbances and objects to the steps taken by the mother to put an end to the situation, more particularly but not restrictively:
a) the adolescent has been diagnosed in the past with a conduct disorder and attention deficit disorder for which he does not take medication;
b) the adolescent has been physically aggressive and intimidating towards his half sisters and mother;
c) the adolescent does not respect the mother’s authority and house rules;
d) the adolescent argues with the mother on a daily basis;
e) when he was just twelve (12) years old, the adolescent chased after his older half sister around the house with a butcher’s knife;
f) the adolescent has made death threats towards his half sister and mother and harasses them in the home;
g) family members in the home have expressed that they are afraid to go to sleep at night, as they fear that the adolescent may kill them in their sleep;
h) the adolescent regularly talks in a positive light about gangs, guns, drugs, terrorism, selling cocaine and drug cartels;
i) the adolescent has brought a hammer and exacto knife to school;
j) on at least one (1) known occasion, the adolescent vandalized school property with an exacto knife;
k) the adolescent has brought alcohol to school and has gotten drunk in the school washroom;”. [ 6 ] Elle reconnaît donc les troubles de comportement de son fils et admet en outre l’avoir négligé sur le plan éducatif. [ 7 ] L’adolescent pour sa part admet notamment les allégations des paragraphes 3.1 et 3.5: “3.1 during periods from approximately 1996 until 2013, the adolescent and his family were known to the Children’s Aid Society on [Province A] due to issues surrounding neglect, conjugal violence as well as substance abuse by the mother; 3.5 the mother does not meet the adolescent’s basic needs in failing to provide the adolescent with appropriate supervision or support, more particularly but not restrictively:
a) the mother consumes marijuana in the home approximately three (3) to four (4) times per week;
b) the mother regularly provides the adolescent with marijuana and alcohol which they sometimes consume together ”. [ 8 ] La Directrice de la protection de la jeunesse demande au Tribunal de prononcer une décision intérimaire afin de compléter l’évaluation de monsieur B par le CAS A à
titre de possible ressource pour héberger l’adolescent. [ 9 ] Après avoir reçu les admissions, pris en considération les témoignages, les rapports produits et la position des parties, le Tribunal conclut à l'existence de motifs sérieux de compromission en application de s articles 38
f) et b) 1 o iii de la
Loi sur la protection de la jeunesse et estime qu'il est dans l'intérêt de l’enfant et le respect de ses droits de rendre l'ordonnance intérimaire qui suit. PAR CONSÉQUENT ET POUR CES MOTIFS, LE TRIBUNAL : [ 10 ] DECLARES that the security and the development of X are in danger ( sections 38
f) and b) 1 o iii) of the Youth Protection Act ); [ 11 ] SETS the continuation of the hearing before the undersigned on June 23, 2015 in room 1.02; [ 12 ] In the meantime: [ 13 ] ORDERS that X remain to a rehabilitation centre; [ 14 ] TAKES JUDICIAL NOTICE that Mr.
B is currently being assessed by CAS A as a possible entrustment home for X; [ 15 ] ORDERS that frequency and modality of contacts between X and his mother be determined by the Director of Youth Protection, taking into consideration X’s wishes; [ 16 ] ORDERS mother not to be under the influence of drug and/or alcohol during her visits with X; [ 17 ] ORDERS X, as he had agreed, to undergo a psychiatric assessment and follow the recommendations made if any; [ 18 ] RECOMMENDS X to access psychosocial services in the community to address his past traumas; [ 19 ] RECOMMENDS mother to seek services to address her past traumas; [ 20 ] RECOMMENDS mother to seek services to address her issues with substance abuse and her parenting skills; [ 21 ] AUTHORIZES the Director of Youth Protection to obtain and share information with all service professionals working with the family; [ 22 ] ORDERS that a person working for an institution or body provide aid, counselling or assistance to X and his family; [ 23 ] ENTRUSTS the situation of X to the Director of Youth Protection A, who shall then see that the measures are carried out; [ 24 ] This decision is enforceable from the moment it is made and any person referred to therein shall comply forthwith and notwithstanding an appeal ( Articles 93 and 105 of the Youth Protection Act ). __________________________________ DOMINIQUE WILHELMY, J.C.Q.
