Partie défenderesse ______________________________________________________________________ JUGEMENT ______________________________________________________________________ [ 1 ] Charbel Estephan réclame des défendeurs, conjointement et solidairement, un montant de 7 000 $ suite à l'acquisition d'une résidence. Il allègue la découverte de vices cachés. [ 2 ] Le 21 décembre 2011, Charbel Estephan se porte acquéreur d'un immeuble propriété de Carole Brouard et Pierre Beaulne. Le prix d'achat se situe à 238 500 $.
À la fin janvier 2012, alors que la température à l'extérieur était d'environ –25 degrés Celsius il constate qu'il n'y a plus d'eau dans la douche et dans le lavabo. [ 3 ] Après avoir tenté de trouver le problème, il découvre qu'il y avait une fuite de la plomberie qui passait sous le plancher de la chambre et qu'il y avait un chauffage électrique d'appoint mais qui n'était pas branché. Il s'exprime ainsi dans sa requête : « 11. On January 12th 2012, I purchased the house for 238,500$ (Exhibit D); 12.
A couple of weeks later, in late January 2012, during a minus twenty-five degrees (- 25) temperature, I attempted to use the water in my bathroom but to no avail; 13. There was no running water in the shower nor in the bathroom sink; 14. A friend of mine, who has experience in constructing homes, was visiting and mentioned that the pipes might be frozen; 15. I took down my drop ceiling to analyse the situation and noticed that a different piping system was running through the addition; 16.
Believing that the problem was the rear foundation of the addition stated in the inspection report, my experienced friend and I closed it up; 17. However, the problem was not solved. The pipes did not unfreeze; 18. I made an opening from the inside of the house to access, frame and cover the mentioned gap; 19. Once this opening was made, the latent defect appeared; 20. Through this opening, there was an electric heater hanging from underneath the bedroom floor (the addition) into the crawl space with a live wire running from the same conjunction box to run the heater into the main bathroom; 21.
On top of the running heater was drywall, tools, garbage, plastic cups, buckets, tools (measuring tape), foam insulation and Styrofoam (Exhibit E);
22. It was an extreme fire hazard. The house could have easily caught on fire; 23. It was confirmed that the problem was not the absence of the heating in the crawl space mentioned in the inspection report. 24. The pipes were not freezing because of any of the reasons mentioned in the inspection report; 25. It is obvious that the pipes were freezing when the Defendants were residing in the residence which explains why they installed the hanging electric heater under the floor; 26. The Defendants never once mentioned this problem; 27.
The Defendants could have easily declared their knowledge of this issue on the " Declaration du Vendeur sur L'immeuble " dated and signed by the Defendant on June 30 th 2011. However, they omitted that information ; (Exhibit F) 28. At the time that the defendant completed the declaration, they were aware that the pipes were freezing since they had installed a hanging electric heater. This information could have been completed under
section D8 (Plomberie et drainage), D10 (chauffage) and most importantly under
section D15 (Améliorations importantes à l'immeuble et precisions (Exhibit F); … » [ 4 ] Glenn Levac, un ami du demandeur et à la fois entrepreneur général témoigne au même effet et mentionne que le problème résulte d'une absence d'isolation et estime que les réparations devraient s'élever à environ 7 000 $ tout comme l'expertise qui est déposée au dossier de la Cour par Charbel Estephan provenant de Les Constructions Mario Raymond, lequel estime qu'un montant de 7 254,18 $ plus les taxes devrait suffire pour corriger les défauts. [ 5 ] En défense, on mentionne que lorsqu’ils ont habité cette résidence, ils n'ont jamais eu de problème avec les tuyaux pour l'eau, de plus ils ajoutent que le demandeur avait été informé qu'il y avait eu infiltration d'eau dans cette résidence.
D'ailleurs une réduction du prix de vente de 256 000 $ à 238 500 $ a été accordée suite au rapport d'inspection. [ 6 ] L'
article 1726 C.c.Q. prévoit que : 1726. Le vendeur est tenu de garantir à l'acheteur que le bien et ses accessoires sont, lors de la vente, exempts de vices cachés qui le rendent impropre à l'usage auquel on le destine ou qui diminuent tellement son utilité que l'acheteur ne l'aurait pas acheté, ou n'aurait pas donné si haut prix, s'il les avait connus.
Il n'est, cependant, pas tenu de garantir le vice caché connu de l'acheteur ni le vice apparent; est apparent le vice qui peut être constaté par un acheteur prudent et diligent sans avoir besoin de recourir à un expert. [ 7 ] Dans le cas d’un recours pour vice caché, l'acheteur doit démontrer que le vice est grave, caché, inconnu de l'acheteur et existant lors de la vente. [ 8 ] Charbel Estephan a démontré chacun de ses éléments. [ 9 ] Le vice est grave, il est caché.
L'expert qui a préparé un rapport d'inspection préalable à l'achat n'a pu le constater, d'autant plus qu'il a fallu pratiquer une ouverture pour constater l'état de la situation. [ 10 ] Par ailleurs, l'acheteur qui réclame une diminution du prix de vente n'a pas automatiquement droit au coût des travaux correctifs.
La diminution du prix s'évaluera en tenant compte de nombreux éléments dont le prix qu'aurait offert l'acheteur s'il avait connu le vice et la position que le vendeur aura adoptée dans les circonstances. [ 11 ] Dans la situation actuelle, si l'inspection pré-achat avait décelé ce problème, le Tribunal ne peut dire, si la vente se serait effectuée au montant de 238 500 $; il n'y a aucune preuve à cet effet. Par ailleurs, il apparaît au Tribunal que l'octroi d'un montant de 2 000 $ saura compenser amplement la perte subie par Charbel Estephan. C'EST POURQUOI LE TRIBUNAL : ACCUEILLE partiellement la requête.
CONDAMNE les défendeurs, Carole Brouard et Pierre Beaulne à payer au demandeur la somme de 2 000 $ avec intérêts au taux légal depuis l'assignation plus l'indemnité additionnelle. LE TOUT avec dépens. __________________________________ MAURICE ABUD, J.C.Q.
