Quiconque contrevient à cette disposition est passible d’une amende (art. 11.2, 11.2.1 et 135 L.P.J.). ______________________________________________________________________ [ 1 ] La présente est la confirmation écrite de la décision rendue oralement le 28 octobre 2014. [ 2 ] La Cour est saisie conformément à l'article 38 de la
Loi sur la protection de la jeunesse d'une demande visant à faire déclarer que la sécurité et/ou le développement de l'adolescent X sont compromis pour les motifs apparaissant particulièrement au troisième paragraphe de la déclaration. [ 3 ] Essentiellement, la Directrice de la protection de la jeunesse allègue : "3.
The security or development of the adolescent is considered to be in danger for the following reasons: 3.1 the adolescent is seriously and repeatedly subjected to behaviour on the part of his mother that could cause him harm, and the adolescent's parents fail to take the necessary steps to put an end to the situation; 3.2 the adolescent runs a serious risk of becoming the victim of bodily injury by the mother and the stepfather and the adolescent's parents fail to take the necessary steps to put an end to the situation, more particularly but not restrictively in that:
a) as relevant information, the adolescent was first known to the Director of Youth Protection in 2009, following a signalement for physical abuse on the part of the mother;
b) the adolescent was subsequently the subject of judgments of this court in file number 525-41-022103-097 and the last measures expired on November 17, 2011;
c) on October 6, 2014, the Director of Youth Protection received a signalement for the adolescent with regards to physical abuse and the fact that the adolescent had not been home for the week-end;
d) the relationship between the adolescent and the mother is conflictual;
e) the adolescent stated that the mother often tells him that she does not want him, that he is too much trouble;
f) the adolescent stated that the mother often threatens to hit him, but that he is able to control her;
g) the adolescent reported that the stepfather has been physically violent with him on two (2) occasions. The last one (1) was during the summer of 2014 when he hit him on his back and arms, leaving marks;
h) the adolescent stated he gets in trouble because he comes home late;
i) the adolescent is very reserved;
j) the adolescent does not want to return to the home and live with the mother;
k) the mother claims the adolescent often lies;
l) the mother reports neighbours have seen the adolescent smoking, that he was caught drinking and she suspects he takes drugs;
m) the mother does not want the adolescent home, as states he creates problems for her;
n) the mother wants the adolescent to go back to [COUNTRY A]; 3.3 on October 6, 2014, immediate protective measures were invoked and the adolescent was placed in a foster home; 3.4 on October 7, 2014, the mother and the adolescent signed provisional measures and the adolescent remained in the foster home; 3.5 on October 8, 2014, the mother advised the worker that she did not want him to remain in a foster home but that she did not want the adolescent back at home into her care; 3.6 the father continues to live in [City A] and the mother is not certain if the adolescent has contacts with him; 3.7 the school did not report any issues with regards to the adolescent's behaviours or academics. [ 4 ] À
titre de mesure principale, la Directrice de la protection de la jeunesse recommande de confier l'adolescent à une famille d'accueil jusqu'à l'atteinte de sa majorité, en plus d’autres mesures visant à corriger la situation de compromission, tel qu'il appert au procès-verbal de l'audition. [ 5 ] La mère, qui est absente de l'audition, a remis une lettre mentionnant son consentement aux mesures proposées par la Directrice. [ 6 ] Le père est absent de l'audition. [ 7 ] L'adolescent, par la voix de son procureur, se dit en accord avec les mesures recherchées par la Directrice. [ 8 ] De consentement et pour valoir preuve, la Directrice de la protection de la jeunesse a versé au dossier les pièces suivantes: - D-1 : Adolescent's Birth Certificate; - D-2: Judgment of the Court of Quebec, Youth Division, dated April 23, 2010, with English Translation, en liasse; - D-3: Judgment of the Court of Quebec, Youth Division, dated may 17, 2011, with English Translation, en liasse; - D-4: Court Report, prepared by A, dated Octoer 21, 2014.
ANALYSE DE LA PREUVE ET DÉCISION [ 9 ] Tel qu'il appert des allégations de la requête, la situation du jeune X est connue de la Directrice de la protection de la jeunesse depuis 2009 alors que celui-ci avait fait l'objet d'un signalement concernant des abus physiques de la part de sa mère.
Cette situation semble se répéter, et le Tribunal doit ajouter que les rapports font état des verbalisations de l'adolescent à l'effet qu'il a également été victime de mauvais traitements physiques de la part de son beau-père. [ 10 ] En plus de cette situation et de la relation conflictuelle mère-fils, le jeune X a découché du foyer maternel la fin de semaine du 3 octobre dernier. Il a donc été intégré dans une famille d'accueil le 6 octobre dernier. Le rapport social fait état de bons comportements de l'adolescent à l'école qu'il fréquente (
A) ainsi que d'une assiduité de l'adolescent à ses cours. Il lui arrive cependant de ne pas faire ses devoirs et sa réussite scolaire est fragile. [ 11 ] L'intervenante sociale note également que depuis son placement en famille d'accueil son comportement est différent et qu'il est
moins anxieux. [ 12 ] Vu les positions exprimées tant par la mère que par l'adolescent le Tribunal considère qu'il est effectivement dans le meilleur intérêt de celui-ci qu'il soit confié à une famille d'accueil jusqu'à l'atteinte de sa majorité. Même si la mère ne collabore pas présentement avec les intervenants de la Direction de la protection de la jeunesse, il est à espérer qu'elle fera les efforts nécessaires pour recréer certains liens avec son fils qui pourront perdurer dans le temps. Il y a lieu également de préparer le jeune X à son autonomie vu qu'il atteindra sa majorité au mois de […] 2015.
PAR CES MOTIFS, LE TRIBUNAL: [ 13 ] DECLARES that the security and development of X are considered compromised according to the
section 38 of the Youth Protection Act; [ 14 ] ORDERS that X be entrusted to a foster family chosen by the A Youth and Family Centres until his age of majority; [ 15 ] TAKES NOTICE that the adolescent will stay in the same foster family where he is presently, the family of Mrs.
C; [ 16 ] ORDERS that the frequency and modality of contacts between the adolescent and his mother be determined with the Director of Youth Protection, taking into consideration the wishes of X; [ 17 ] ORDERS that the mother fully collaborate with the Director of Youth Protection of A; [ 18 ] AUTHORIZES the Director of Youth Protection to have access to and share relevant information with all professionals involved with X; [ 19 ] ORDERS that a person working for the A Youth and Family Centres or for any other establishment or organism provide aid, counsel and assistance to the adolescent and his family until his age of majority; [ 20 ] ENTRUSTS the situation of the adolescent to the Director of Youth Protection of A Youth and family Centres, who shall then see that the measures are carried out. __________________________________ GUY LECOMPTE, J.C.Q.
