THE COURT The application for leave to appeal the sentence and the appeal are allowed. The sentence is varied to one of incarceration for two months, but its execution is stayed.
The following is the judgment delivered by THE COURT (Orally) [1] On April 4, 2017, Lee Ross MacArthur pled guilty to the indictable offence of assault with a weapon (s. 267(
a) of the Criminal Code ). On July 12, 2017, a judge of the Provincial Court imposed upon Mr. MacArthur a conditional sentence for a period of four months. A few days later, the Attorney General of New
Brunswick filed a Notice of Appeal seeking a variation of the sentence on the sole ground that it is not one allowed by law. [2] The Attorney General is correct. A conditional sentence is not available for the offence to which Mr. MacArthur pled guilty.
Section 742.1(e)(iii) of the Criminal Code prohibits the imposition of such a sentence for an offence prosecuted by way of indictment that involved the use of a weapon. [3] Counsel for the Attorney General seeks a variation of the sentence to one of incarceration for two months. However, recognizing that Mr. MacArthur has already served the conditional sentence in its entirety, counsel for the Attorney General submits this Court should stay the execution of the sentence. Counsel for Mr. MacArthur agrees the application for leave to appeal and the appeal should be allowed and concurs with the proposed disposition.
We too agree. [4] For these reasons, the application for leave to appeal the sentence and the appeal are allowed. The sentence is varied to one of incarceration for a period of two months. However, since Mr. MacArthur has already served the sentence originally imposed, we stay execution of the sentence of incarceration. All ancillary orders issued in the Provincial Court remain unaffected.
